A RESOLUTION OF THE TOWN OF FOUNTAIN HILLS,ARIZONA,
INSTRUCTING THE ENGINEERING DEPARTMENT TO IDENTIFY AND
LIST ALL UNNEEDED EASEMENTS AND PREPARE PROPOSALS,
WITH UTILITY CONCURRENCE,FOR MASS ABANDONMENTS;
INCREASING THE 1996-97 ENGINEERING BUDGET BY $15,000 TO PAY
FOR THE AFOREMENTIONED WORK.
WHEREAS,thereexistswithintheTownofFountainHillsnumerousutility easements
infavoroftheTownandvariousutilitycompanieswhicharenolongerneededinorderto
provide utility services to homes within the Town;and
WHEREAS,the existence of suchunneeded easements frequently interferes withthe
orderly development of homes,swimming pools,walls,fences,and other amenities withthe
Town;and
WHEREAS,ithasbeenthe practice oftheTowntoreleasesuch easements ona
piecemeal basisinordertopermitsuch development,atasignificantcostoftime,money,and
effortonthepartofTownstaff,tohomebuildersandtothehomebuildingindustry;
NOW,THEREFORE,BE IT RESOLVED THAT theEngineeringDepartmentis
hereby instructed to undertake the examination of all existing lotswithinthe Town to determine
iftheyare burdened bysuch unneeded easements,to prepare a comprehensive listingofallsuch
unneeded easements,toseekadvicefromutility companies regarding their willingness toabandon
such easements andtopresenttotheTown Council,inoneormore packages,proposalsto
abandon such easements en masse;and
BE IT FURTHER RESOLVED THAT in order topaythe estimated $15,000 cost of
suchwork,thebudgetofthe Engineering Department for 1996-97 shallbe increased bythesum
of $15,000;and
PASSED AND ADOPTED THIS 11th day of July,1996.
