A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS,ARIZONA ABANDONING WHATEVER
RIGHT,TITLE,OR INTEREST IT HAS INA PORTION OF THE CERTAIN
PUBLIC UTILITY AND DRAINAGE EASEMENTS ALONG THE
EASTERLY LOTLINEOFLOT2,BLOCK 1OF PLAT 603C,FOUNTAIN
HILLS,ARIZONA,AS RECORDED IN BOOK161OFMAPS,PAGE43,
RECORDS OF MARICOPA COUNTY,ARIZONA.
WHEREAS,The Town Council of the Town of Fountain Hills,asthe governing body of
realpropertylocated in the Town ofFountain Hills,mayrequirethe
dedicationof public streets,sewer,water,drainage,andother utility
easements or rights-of-way withinany proposed subdivision;and
WHEREAS,The Town Council oftheTownofFountain Hills hasthe authority toaccept
orrejectoffersof dedication ofprivatepropertyby easement,deed,
subdivision,plat or other lawful means;and
WHEREAS,All present utility companies havereceived notification oftheproposed
abandonment;
NOW THEREFORE,beit resolved by the Mayor and Common CounciloftheTownof
Fountain Hills,Arizona as follows:
SECTION1.Thatthecertainten (10)footpublic utility and drainage easements,located
along the easterly property lineof Plat 603C,Block 1,Lot2,Fountain Hills,
Arizona;asrecordedinbook161ofmaps,page 43recordsofMaricopa
County,Arizona;are hereby declared tobe abandoned bytheTownof
Fountain Hills,except thatthenortherlytenfeet (10')ofthe public utility
easement shallberetained;andthe southerly 10'ofthepublic utility and
drainage easement shall be retained;as shown on the attached Exhibit "A".

SECTION 2.ThatthisResolutionis one of abandonment and disclaimer bytheTown
solely for the purpose of removing any potential cloud on the titleto said
propertyandthattheTown in noway attempts toaffecttherightsofany
private partyto oppose the abandonment or assert anyrightresulting
therefrom or existing previous to any action by the Town.
PASSED AND ADOPTED this 1st day of August,1996.
