A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS,ARIZONA ABANDONING WHATEVER
RIGHT,TITLE,OR INTEREST IT HAS INA PORTION OF THE CERTAIN
PUBLIC UTILITY AND DRAINAGE EASEMENTS ALONG THE
SOUTHERLY LOT LINES OF LOTS 5,6,7,AND BETWEEN LOTS 5 AND
6OFBLOCK1,PLAT207,FOUNTAIN HILLS,ARIZONA,AS
RECORDED IN BOOK 147 OF MAPS,PAGE6,RECORDS OF
MARICOPA COUNTY,ARIZONA.
WHEREAS,The Town Council ofthe Town ofFountain Hills,asthe governing bodyof
realpropertylocatedintheTownofFountain Hills,mayrequirethe
dedicationof public streets,sewer,water,drainage,andother utility
easements or rights-of-way within any proposed subdivision;and
W WHEREAS,The Town Council oftheTownofFountain Hills hastheauthorityto accept
orrejectoffersof dedication ofprivatepropertyby easement,deed,
subdivision,plat or other lawful means;and
WHEREAS,All present utility companies havereceived notification oftheproposed
abandonment;
NOW THEREFORE,beit resolved by the Mayor and Common Councilof the Townof
Fountain Hills,Arizona as follows:
SECTION 1.Thatthecertainten (10)footpublic utility and drainage easements,located
alongthe southerly propertylineandthetwenty(20)footpublic utility and
drainage easement located between Lots5 and 6of Plat 207,Block 1,Lots
5,6and7,Fountain Hills,Arizona;as recorded inbook147of maps,page
6 records of Maricopa County,Arizona;are hereby declared tobe
abandoned by the Town of Fountain Hills.
SECTION 2.ThatthisResolutionisoneof abandonment anddisclaimerbytheTown
solely for the purpose of removing any potential cloud on the titleto said

property and thattheTown in noway attempts toaffecttherightsofany
privatepartyto oppose the abandonment or assert anyrightresulting
therefrom or existing previous to any action bytheTown.
PASSED AND ADOPTED this15th day of August,1996.
