A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS,ARIZONA ABANDONING WHATEVER
RIGHT,TITLE,OR INTEREST IT HAS INA PORTION OF THE CERTAIN
PUBLIC UTILITY AND DRAINAGE EASEMENTS ALONG THE COMMON
LOT LINE OF LOT 9 AND 10,BLOCK 1 OF PLAT 505C,AND A
CERTAIN PUBLIC UTILITY AND DRAINAGE EASEMENTS AT THE
NORTHEAST PROPERTY LINE OF LOT 10 AND A CERTAIN PUBLIC
UTILITY AND DRAINAGE EASEMENT AT THE SOUTHERLY PROPERTY
LINE OF LOT 9,FOUNTAIN HILLS,ARIZONA,AS RECORDED IN BOOK
158 OF MAPS,PAGE 42,RECORDS OF MARICOPA COUNTY,
ARIZONA.
WHEREAS,The Town Council of the Town of Fountain Hills,as the governing body of
real property located in the Town of Fountain Hills,may require the
dedication ofpublic streets,sewer,water,drainage,and other utility
easements or rights-of-way within any proposed subdivision;and
WHEREAS,The Town Council of the Townof Fountain Hills has the authority to accept
or reject offers of dedication of private property by easement,deed,
subdivision,plat or other lawful means;and
WHEREAS,All present utility companies have received notification of the proposed
abandonment;
NOW THEREFORE,be it resolved by the Mayor and Common Council of the Townof
Fountain Hills,Arizona as follows:
SECTION 1.That the certain twenty (20)foot public utility and drainage easements,
located along the common property lineof Plat 505C,Block 1,Lot9 and
10,and the ten (10)foot public utility and drainage easement located at the
northeast property line (adjacent toLot 27)ofLot 10,Block 1,Plat 505C,
and the ten (10)foot public utility and drainage easement located at the
southerly property line (adjacent toLot27)ofLot9 and 10,Block 1,Plat
505C,Fountain Hills,Arizona;as recorded in book 158 of maps,page 42

records ofMaricopaCounty,Arizona;are hereby declared tobe abandoned
by the Town of Fountain Hills.
SECTION2.ThatthisResolutionisoneof abandonment anddisclaimerbytheTown
solely for the purpose ofremoving any potential cloudon the titleto said
propertyandthattheTown in noway attempts toaffecttherightsofany
privatepartyto oppose the abandonment or assert any right resulting
therefrom or existing previous to any action by the Town.
