RESOLUTION DECLARING THE RESULT OF,AND ADOPTING A CERTIFICATE OF
RESULT OF,THE SPECIAL BOND ELECTION HELD ON SEPTEMBER 10,1996;
ORDERING THE RECORDING OF SUCH CERTIFICATE AND DECLARING AN
EMERGENCY.
BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS,ARIZONA,as follows:
Section 1.After careful examination of the official returns of the special bond
election held inand for the Town of Fountain Hills on September 10,1996,itis found and
determined bythe Mayor and Council as follows:
(A)A majority of those qualified electors votingatthe aforementioned special
bond election voted "Bonds No"as shown on the attached Certificate of Result of Election;
(B)The Mayor and members of this Council present thisdate will execute the
attached Certificate of Result of Election;
(C)The Clerk is hereby directed to record the attached Certificate of Result of
Election inthe office of the County Recorder of Maricopa County,Arizona,andto return said
copywiththe recording data shown thereon tothe official records of thisbody.
Section 2.The immediate operation of the provisions of this resolution is
necessary forthe preservation of the public peace,health andsafetyandan emergency ishereby
declared to exist,andthis resolution will beinfull force and effect from and after its passage
and approval bythe Mayor and Council as required by law anditis hereby exempt from the
referendum provisions of the Constitution andlaws of the State of Arizona.
PASSED AND ADOPTED bythe Mayor and Council of the Town of Fountain
Hills,Arizona,on September 19,1996.

HILLS,ARIZONA,RELATIVE TO THE SPECIAL BOND ELECTION HELD ON
SEPTEMBER 10,1996.
TheMayorand Council oftheTownofFountainHills,Arizona,hereby certify
as follows:
1.PursuanttotheresolutionpassedandadoptedbytheMayorandCouncilon
May16,1996,an election wasdulyand regularly heldon September 10,1996,forthe purpose
ofapprovingtheissuanceandsaleofbondsinthetotalprincipalamount of $1,950,000to
providefundstomakevariousmunicipalimprovements.
2.The election had been conducted and the official returns thereof have been
filedasrequiredbylawandthatthetotalnumberofvotescastatthe special bondelectionin
answertothe question submitted wereasfollows:

Thetabulatedvotesforthebondquestionissetforthintheattachedfinalcumulativereport.
3.Eachandeverypersonwhovotedatthespecialbondelectionwasaqualified
elector of the Town of Fountain Hills.
4.ThemajorityofthevotescastattheelectionwereagainstthisCouncilincurring
indebtednessoftheTowninthetotalauthorizedprincipalamount of $1,950,000 bytheissuance
andsale of all of the bonds described inthe question.

BALLOTS CAST AT THE SPECIAL BOND ELECTION HELD IN THE TOWN OF
FOUNTAIN HILLS,ARIZONA,ON SEPTEMBER 10,1996.
WHEREAS,atthespecialbond election heldinandforthe Town of Fountain
Hills,Arizona(the"Town"),onSeptember10,1996,votingmachineswereusedbytheTown
toevidencetherespectivevotesofthosequalifiedelectorsvotingatsuchelection;and
WHEREAS,theMaricopaCountyElectionsDepartmentaidedtheTownin
tabulatingthevotescast;and
WHEREAS,theundersignedactedasthepersonresponsibleforthecorrect
countingoftheballotscastattheabove-mentionedspecialbondelection;and
WHEREAS,I havecausedthevotetabulatingequipmenttocounttheballotsso
astoshowthereturnsforeachpoll,allasshownontheattachedreturn;and
WHEREAS,astheagentfortheTown,Ihavecausedcertain questioned ballots
tobeverifiedandIherewithreturnsuchquestionedballotstotheTown;
NOW,THEREFORE,pursuant toSection 16-622,Arizona Revised Statutes,I
hereby certifythatthe returns printedbythevote tabulatingequipment located atthe official
ballot counting center,which returnis attached hereto and made apart hereof,contains atrue
and correct count ofallofthe ballots except the enclosed questioned ballots andany absentee
questioned ballots held bythe Town,both those castatthe individual voting precincts and
absentee whichwerethen available for tabulation,atthe special bondelectionheldintheTown
ofFountainHillsonSeptember10,1996.

A RESOLUTION OF THE MAYOR AND COMMON
COUNCIL OF THE TOWN OF FOUNTAIN HILLS,
ARIZONA REPEALING RESOLUTION #1996-59 AND
DECLARING THAT CERTAIN DOCUMENT KNOWN AS
THE SUBDIVISION ORDINANCE OF THE TOWN OF
FOUNTAIN HILLS,OCTOBER 3,1996,CHAPTER 15 OF
THE TOWN CODE,A PUBLIC RECORD PURSUANT TO
ARIZONA REVISED STATUTES §9-801.
BE IT RESOLVED bythe Mayor and Common CounciloftheTownofFountain
Hills,Arizona,as follows:
Section 1.That Resolution 1996-59isherebyrepealed.
Section 2.That ArizonaRevisedStatutes §9-801et.seq.providesfor
the adoption by reference of public records.
Section 3.That attached hereto isa document known as The Subdivision
Ordinance of theTown of FountainHills,October3,J996.
Section 4.That said document is hereby declared tobea public record
andthatthree(3)copies thereof shallbekeptonfileintheofficeoftheTownClerkforpublic
use and inspection during regular business hours.
PASSED AND ADOPTED bythe Mayor and Common Council of the Town of
Fountain Hills,Arizona this third day of October,1996.
