THE TOWN OF FOUNTAIN HILLS,ARIZONA ABANDONING
WHATEVER RIGHT,TITLE,OR INTEREST IT HAS INA
PORTION OF THE CERTAIN PUBLIC UTILITY AND DRAINAGE
EASEMENTSALONGTHE EASTERLY LOT LINE OFLOT16,
BLOCK7OFPLAT203,FOUNTAIN HILLS,ARIZONA,AS
RECORDED IN BOOK 149OFMAPS,PAGE29,RECORDS OF
MARICOPA COUNTY,ARIZONA.
The Town Council ofthe Town of Fountain Hills,asthe governing bodyof
realproperty located in the Town of Fountain Hills,mayrequirethe
dedication ofpublicstreets,sewer,water,drainage,and other utility
easements or rights-of-way within any proposed subdivision;and
The Town Council ofthe Town of Fountain Hills hasthe authority to accept
or reject offersof dedication of private property by easement,deed,
subdivision,plat or other lawful means;and
All present utility companies have received notificationofthe proposed
abandonment;
NOW THEREFORE,be it resolved by the Mayor and Common Council of the Townof
Fountain Hills,Arizona as follows:
SECTION 1.That the certain twenty(20)footpublic utility and drainage easements,
located along the easterly property line of Plat 203,Block7,Lot 16,Fountain
Hills,Arizona;as recorded in book 149of maps,page 29 records of
Maricopa County,Arizona;are hereby declared to be abandoned bythe
Town of Fountain Hills,except for the southerly twenty (20)feetjand except
for the northerlyfifteen (15)feet of the public utility easement,allasshown
in Exhibit A.
SECTION 2.ThatthisResolution is one of abandonment and disclaimer by the Town
solely for the purpose of removing any potential cloud on the title to said
property and that the Towninno way attempts to affect the rightsof any
private party to oppose the abandonment or assert any right resulting
therefrom orexisting previous to any action by the Town.
