ARESOLUTIONOF THE MAYOR AND COMMON COUNCIL OF
THE TOWNOF FOUNTAIN HILLS,ARIZONA ABANDONING
WHATEVER RIGHT,TITLE,OR INTEREST IT HASTHAT CERTAIN
DRAINAGE EASEMENT AND A PORTION OFTHEPUBLIC UTILITY
EASEMENT AFFECTING ALONG THE SOUTH LOT UNE OF LOT 12,
BLOCK7,OF PLAT 111 FOUNTAIN HILLS,ARIZONA,AS
RECORDED INBOOK149OFMAPS,PAGE22,AND AFFIDAVIT
OF CORRECTION RECORDED IN BOOK 150 OFMAPS,PAGE 12
RECORDSOF MARICOPA COUNTY,ARIZONA.
WHEREAS,The Town Councilof the Town ofFountain Hills,as the governing body of
real property located in the Townof Fountain Hills,may require the
dedication of public streets,sewer,water,drainage,and other utility
easements or rights-of-way within any proposed subdivision;and
WHEREAS,TheTown Council of the Townof Fountain Hills has the authority to accept
or reject offers of dedication of private property by easement,deed,
subdivision,plat or other lawful means;and
WHEREAS,All present utility companies have received notification of the proposed
abandonment;
NOW THEREFORE,be it resolved by the Mayor and Common Council of the Townof
Fountain Hills,Arizona as follows:
SECTION 1.That the certain twenty (20)foot public utility and drainage easement,
located along the south property line of Lot 12,Block 7,Plat 111,Fountain
Hills,Arizona;as recorded in book 149of maps,page 22 and affidavit of
correction recorded in book 150 of maps,page 12 records of Maricopa
County,Arizona;is hereby declared to be abandoned by the Townof
Fountain Hills,except for the westerly 15'of the public utility easement to
be retained.

SECTION 2.That this Resolution is one of abandonment and disclaimerbythe Town
solely for the purpose of removing any potential cloud on the title to said
property and that the Towninno way attempts to affect the rightsof any
private party to oppose the abandonment or assert any rightresulting
therefrom orexisting previous to any action by the Town.
