RESOLUTION 1995-18
ARESOLUTIONOF THE MAYOR AND COMMON COUNCIL OF
THE TOWNOFFOUNTAIN HILLS,ARIZONA PURSUANT TO A.R.S.
§28-1901 EL SEQ.ABANDONING TO THE ADJACENT PROPERTY
OWNER ALLRIGHT,TITLE OR INTEREST INACERTAINPORTIONOF
APUBUC RIGHT-OF-WAY,FOUNDTOBE NO LONGER
NECESSARY FOR PUBUC USE.
WHEREAS,A.R.S.§28-1901 et.sea,provides for the disposition of unnecessary public
roads;and
WHEREAS,The Town Councilofthe Town of Fountain Hills is thegoverningbodyofthe
Town;and
NOW THEREFORE,be it resolved by the Mayor and Common Council of the Townof
Fountain Hills,Arizona,as follows:
SECTION 1.That the portion of Stardust Circle right-of-way,located within Fountain Hills,
Arizona Final Plat Number 412-A,as recorded inBook158,Page 20,
Maricopa County Recorder Records,which is legally described In Exhibit "A"
and graphically depicted in Exhibit "B",attached hereto,and Incorporated
herein Is hereby declared to be no longer necessary for public useasright-
of-way.
SECTION 2.That the portion of Stardust Circle right-of-way,located within Fountain Hills,
ArizonaFinalPlat Number 412-B,as recorded inBook163,Page 2,Maricopa
County Recorder Records,which is legally described in Exhibit "A"and
graphically depicted inExhibit "B",attached hereto,and incorporated
herein is hereby declared to be no longer necessary for public use as right-
of-way.
SECTION 3.That the Council determines this property can best be used to protect the
public health,safety and welfare of the adjacent property owners and the
citizens of the Town and therefore declares that the value of the property
is the minimis and that no compensation is required from the adjacent
property owners pursuant to A.R.S.§28-1902.A.3 and §28-1902.A.5.

SECTION 4.That upon recordation of this resolution in the office ofthe Maricopa
County Recorder,titleto the property legally described in Exhibit "A"and
depicted in Exhibit "B"shall vest in theownersofrecordofthe adjacent
property as determined by the recordsof the Maricopa CountyRecorder
on the day of recordation.
