A RESOLUTION OFTHE MAYOR AND COMMON COUNCIL OF
THE TOWN OF FOUNTAIN HILLS,ARIZONA PURSUANT TO A.R.S.
§28-1901 ET.SEQ.ABANDONING TOTHE ADJACENT PROPERTY
OWNER ALLRIGHT,TITLE OR INTERESTINA CERTAIN PORTION OF
APUBLIC RIGHT-OF-WAY,FOUNDTOBE NO LONGER
NECESSARY FOR PUBLIC USE.
WHEREAS,A.R.S.§28-1901 et.seq.provides for the disposition of unnecessary public
roads;and
WHEREAS,TheTown Council of the Townof Fountain Hills is the governing body of the
Town;and
NOW THEREFORE,be it resolved by the Mayor and Common Council of the Town of
Fountain Hills,Arizona,as follows:
SECTION 1.That the portion of Puma Drive right-of-way,located within Fountain Hills,
Arizona Final Plat Number 605-C,as recorded inBook164,Page 14,
Maricopa County Recorder Records,which is legally described inExhibit "A"
and graphically depicted inExhibit "Bu,attached hereto,and incorporated
herein is hereby declared to be no longer necessary for public use as right-
of-way.
SECTION 2.That the Council determines this property can best be used to protect the
public health,safety and welfare of the adjacent property owners and the
citizens of the Town and therefore declares that the value of the property
is the minimis and that no compensation is required from the adjacent
property owners pursuant to A.R.S.§28-1902.A.3 and §28-1902.A.5.
SECTION 3.That upon recordation of this resolution in the office of the Maricopa
County Recorder,title to the property legally described inExhibit "A"and
depicted in Exhibit "B"shall vest in the owners of record of the adjacent
property as determined by the records of the Maricopa County Recorder
on the day of recordation.

A part of Puma Drive in Fountain Hills Arizona Final Plat No.
605-C,in Section 21,Township 3North,Range 6 East of the Gila
and Salt River Base and Meridian,as recorded on July 17,1973 in
Book 164,Page14oftherecordsofMaricopaCounty,Arizona,more
particularly described as follows:
BEGINNING at the most southerly corneronthe southeasterly right
ofway line of Puma Drive of said Plat No.605-C,thence North 78
degrees 44 minutes 41 seconds West a distance of 25.45 feet to a
point on curve,said curve being concave northwesterly and having
aradiusof45.00 feet,a radial line passingthroughsaidpoint
bearsSouth10degrees41minutes26secondsEast;thence
northeasterly along the arc of said curve through a central angle
of 60 degrees 33 minutes 34 seconds an arc length of 47.56 feet to
a point of cusp,said point being on a curve concave easterly and
having a radius of 275.00 feet,a radial line passing through said
point bears North 71 degrees 15 minutes 00 seconds West;thence
southerly along the arc of said curve through a central angle of 07
degrees 29 minutes 41 seconds an arc length of 35.97 feet to the
POINT OF BEGINNING.
This parcel contains an area of 253.9 square feet of 0.0058 acres.
