RESOLUTION 1995-40
A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF
THE TOWNOF FOUNTAIN HILLS,ARIZONA ABANDONING
WHATEVER RIGHT,TITLE,OR INTEREST IT HASIN THE CERTAIN
DRAINAGE AND PUBLIC UTILITY EASEMENTS ALONG THE
WESTERLY LOT UNE OF LOT 43,BLOCK 1,OF PLAT 602A
FOUNTAIN HILLS,ARIZONA,AS RECORDED INBOOK161OF
MAPS,PAGE42,RECORDS OFMARICOPA COUNTY,ARIZONA.
WHEREAS,The Town Council ofthe Town of Fountain Hills,asthe governing bodyof
real property located in the Town ofFountain Hills,may require the
dedication ofpublicstreets,sewer,water,drainage,and other utility
easements or rights-of-way within any proposed subdivision;and
WHEREAS,The Town Council ofthe Town of Fountain Hills hasthe authority to accept
or reject offersof dedication of private property by easement,deed,
subdivision,plat or other lawful means;and
WHEREAS,All present utility companies have received notification oftheproposed
abandonment;
NOW THEREFORE,be it resolved by the Mayor and Common Council of the Townof
Fountain Hills,Arizona as follows:
SECTION 1.That the certain ten (10)footpublic utility and drainage easement,located
along the westerly property line of Plat 602A,Block 1,Lot 43,Fountain Hills,
Arizona;as recorded in book 161 of maps,page 42 records of Maricopa
County,Arizona;is hereby declared to be abandoned by the Townof
Fountain Hills;except that a one-foot drainage easement shall be retained.
SECTION 3.That this Resolution is one of abandonment and disclaimerby the Town
solelyfor the purpose of removing any potential cloud on the title to said
property and that the Townin no way attempts to affect the rightsof any
private party to oppose the abandonment or assert any rightresulting
therefrom orexisting previous to any action by the Town.
