RESOLUTION OF THE TOWN OF FOUNTAIN HILLS
APPROVING THE APPLICATION FOR ARIZONA STATE PARKS BOARD HERITAGE
FUNDS OR LAND WATER CONSERVATION FUNDS
GOLDEN EAGLE COMMUNITY PARK -PHASE IV
WHEREAS,the Legislature underARS§41-503has authorized the establishment of the
Heritage Fund program,providing matching funds tothe State of Arizona,its political
subdivisions for acquiring landsand developing facilities for public outdoor recreation purposes;
and
WHEREAS,the Congress underPublicLaw88-578has authorized the establishment of
a Federal LandandWater Conservation fund Grant-in-aid Program,providing matching funds
tothe State of Arizona,its political subdivisions and Indian Tribes for acquiring lands and
developingfacilitiesforpublicoutdoorrecreationpurposes;and
WHEREAS,theArizonaStateParksBoard(ASPB)isresponsibleforthe administration
oftheprogramwithintheState,settingupnecessaryrulesandproceduresgoverningapplication
bylocal agencies underthe program;and
WHEREAS,saidadopted procedures established by ASPB requirethe Applicant to
certifybyresolutiontheapprovalofapplications,signatureauthorization,theavailabilityoflocal
matchingfunds,andauthorizationtosignaParticipantAgreementwithASPBpriortosubmission
of said applications to ASPB;and
WHEREAS,the proposed project mustbe consistent withthe Arizona State
Comprehensive Outdoor Recreation Plan;and
WHEREAS,the project mustbe compatible withthelanduseplans of theapplicant;
NOW,THEREFORE,BEIT RESOLVED thattheTownofFountainHillshereby:
1.Approves thefiling of an application for Arizona Heritage Fund or Land and Water
Conservation Fund assistance;and
2.Certifies thatthe Town of Fountain Hills will comply with all appropriate state and
federal regulations,policies,guidelines,and requirements asthey relate tothe application;and
3.Certifies thatthe Town of Fountain Hills has matching funds inthe amount of $805,000
from the following sources:Fountain Hills General Fund;andcan finance 100 percent of the
project,half of which willbe reimbursed byan Arizona State Parks Board Heritage grant or Land
and Water Conservation fund grant;and

4.CertifiesthattheTownofFountainHillshasthenon-projectsurchargenottoexceedten
percentoftotalprojectcostswhichwillbepaidtoASPBuponAORCCapprovalofsaid
application,if itis selected for LWCF assistance;and
5.Certifies thatthe project is compatible withthelanduseplans of theTown of Fountain
Hills;and
6.Certifiesthattheprojecthasbeenreviewedbytheparksmaintenanceandoperationsstaff
oftheTownofFountainHillsandthattheTownagreestoproperlymaintainthisproject;and
7.AppointstheTown of Fountain Hills'DirectorofParksandRecreationasagentoftheTown
ofFountainHillstoconductallnegotiations,executeandsubmitalldocumentsincludingbutnot
limitedtoapplications,agreements,amendments,billingstatements,andsoonwhichmaybe
necessary forthe completion of the aforementioned project.
PASSED,ADOPTED AND APPROVED bytheTownofFountainHillsthis5thday
of July,1995.
