AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS,ARIZONA,ADOPTING THE "2014 DEVELOPMENT
IMPACT FEE ORDINANCE OF THE TOWN OF FOUNTAIN HILLS"BY
REFERENCE AND AMENDING THE TOWN OF FOUNTAIN HILLS TOWN
CODE,CHAPTER 7 (BUILDINGS AND BUILDING REGULATIONS),
ARTICLE7-10(DEVELOPMENTFEES),BYDELETINGITINITS
ENTIRETY AND REPLACING IT WITH THE 2014 DEVELOPMENT
IMPACT FEE ORDINANCE OF THE TOWN OF FOUNTAIN HILLS.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS as follows:
SECTION 1.The document known asthe "2014 Development Impact Fee Ordinance of
the Town of Fountain Hills"(the"2014 Impact Fee Ordinance"),three copies of which areon
file inthe office of the Town Clerk,which document was made a public record by Resolution
No.2014-31 ofthe Town of Fountain Hills,Arizona,is hereby referred to,adopted and made a
part hereof asiffullysetoutinthisOrdinance.
SECTION 2.The Fountain Hills Town Code,Chapter 7 (Buildings and Building
Regulations),Article 7-10 (Development Fees),is hereby deleted inits entirety and replaced
withthe 2014 ImpactFeeOrdinance.
SECTION 3.Any person who fails to comply with any provision ofthe 2014 Impact Fee
Ordinance shallbesubjecttociviland criminal penalties asset forth inArticle1-8ofthe
FountainHillsTownCode,includingcivilpenalties of notmorethan$500base fine.Criminal
penalties shall constitute aclassone misdemeanor,punishable byafinenottoexceed $2,500.00
orby imprisonment fora period notto exceed six months,orbybothsuch fine and
imprisonment.Each daythata violation continues shallbea separate offense.
SECTION4.Ifanysection,subsection,sentence,clause,phraseorportionofthis
Ordinance isforany reason heldtobe invalid or unconstitutional bythe decision ofanycourtof
competentjurisdiction,such decision shallnotaffectthe validity ofthe remaining portionsof
this Ordinance.
SECTION 5.TheMayor,theTown Manager,theTownClerkandtheTown Attorney
areherebyauthorizedanddirectedtoexecutealldocumentsandtakeallstepsnecessarytocarry
outthe purpose and intent of this Ordinance.
