AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS,ARIZONA,AMENDING ARTICLE 9-4OF THE
FOUNTAIN HILLS TOWN CODE RELATED TO THE STATE OF ARIZONA
LAW ON THE REGULATION OF FIREARMS.
WHEREAS,the Mayor and Town Council of the Town of Fountain Hills (the "Town
Council")desire to amend the Fountain Hills Town Code ("Town Code")to bring it into
conformance with Arizona law related to municipal regulation of the possession and carrying of
firearmsinTownparks.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND COUNCIL OF
THE TOWN OF FOUNTAIN HILLS,ARIZONA as follows:
SECTION 1.The recital above is hereby incorporated asif fully set forth herein.
SECTION 2.The Town Code Chapter 9 (Parks and Recreation),Article 9-4 (Park Rules
and Regulations),Section 9-4-3(A)(Rules and Regulations at Town Owned Parks),is hereby
amended as follows:
A.All persons who use Town owned Parksshallobeythe following rules whileon
park property.
Nofirearmsor weapons,EXCEPT AS AUTHORIZED BY
ARIZONA LAW.
SECTION 3.Ifany section,subsection,sentence,clause,phrase or portion ofthis
Ordinance isforany reason held tobe invalid or unconstitutional bythe decision ofanycourtof
competent jurisdiction,such decision shallnotaffectthe validity ofthe remaining portions of
this Ordinance.
SECTION 4.The Mayor,theTown Manager,theTownClerkandtheTown Attorney
are hereby authorized and directed toexecuteall documents andtakeallsteps necessary tocarry
outthe purpose andintent of this Ordinance.
