A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF
FOUNTAINHILLS,ARIZONA,ABANDONING WHATEVER RIGHT,TITLE,OR
INTEREST IT HAS IN THE PUBLIC UTILITY AND DRAINAGE EASEMENTS AT THE
REAROFTHE PROPERTY LINEOFPLAT111,BLOCK7LOT6,FOUNTAIN
HILLS,ARIZONA,AS RECORDED IN THE OFFICE OF THE COUNTY RECORDER
OF MARICOPA COUNTY,ARIZONA,RECORDED INBOOK 150 OFMAPS,PAGE
12.
WHEREAS,theMayorandCounciloftheTownofFountain Hills (the"TownCouncil"),as the
governingbodyofrealpropertylocatedintheTownofFountain Hills (the "Town"),mayrequirethe
dedicationof public streets,sewer,water,drainage,andother utility easements or rights-of-way within any
proposed subdivision;and
WHEREAS,theTownCouncilhastheauthorityto accept orrejectoffersofdedicationofprivate
property by easement,deed,subdivision,plator other lawful means;and
WHEREAS,all present utility companies have received notificationofthe proposed abandonment.
NOW THEREFORE,BEIT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS,as follows:
SECTION1.Thatthecertainpublic utility easement,locatedattherearpropertylineofPlat 111,
Block7,Lot6,Fountain Hills,as recorded theOfficeoftheCounty Recorder ofMaricopaCounty,Arizona,
Book150ofMaps,Page 12,and as more particularly described inExhibitA,attached hereto and
incorporated herein by reference,are hereby declared tobe abandoned bytheTown.Certain lotswithin
thissubdivisionare subject tolot-to-lot drainage runoff.Theproperty owner isrequiredto pass the
developed flows generated bythe upstream lots across theirproperty.
SECTION2.ThatthisResolutionis one of abandonment and disclaimer bytheTownsolelyfor
the purpose ofremovingany potential cloudonthetitleto said property and that theTowninnoway
attempts toaffecttherightsofanyprivatepartyto oppose the abandonment or assert anyrightresulting
there fromorexisting previous to any action bytheTown.
