AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS,ARIZONA,AMENDING THE TOWN OF FOUNTAIN
HILLS ZONING ORDINANCE,CHAPTER 6,SIGN REGULATIONS,
RELATING TO A-FRAME SIGNS AND BANNERS.
WHEREAS,the Mayor and Council of the Town of Fountain Hills(the "Town
Council")adopted Ordinance No.93-22,which established the Zoning Ordinance forthe Town
of Fountain Hills (the "Zoning Ordinance");and
WHEREAS,the Town Council desires to amend the Zoning Ordinance to revise Chapter
6(Sign Regulations)to(i)extendthetime period duringwhichA-framesignsarealloweduntil
December 31,2015,and(ii)extend thetime period during which banners,balloonsand pennants
arepermittedforcertaineventsuntil December 31,2015;and
WHEREAS,in accordance with the Zoning Ordinance and pursuant to Ariz.Rev.Stat.
§9-462.04,asamended,publichearingsregardingthisOrdinancewereadvertisedinthe
October 29,2014,edition of the Fountain Hills Times',and
WHEREAS,publichearingswereheldbytheFountainHillsPlanningandZoning
Commission(the "Commission")onNovember13,2014,andbytheTownCouncilon
December 18,2014;and
WHEREAS,the Commission recommended approval of this Ordinance,but
recommended that further extensions be denied if therate of compliance withtheadopted
regulationsdoesnotimproveto80%byDecember1,2015.
NOW,THEREFORE,BE IT ORDAINED BYTHE MAYOR ANDCOUNCILOF
THE TOWN OF FOUNTAIN HILLS as follows:
SECTION 1.Therecitalsaboveareherebyincorporatedas if fullysetforthherein.
SECTION 2.TheZoningOrdinance,Chapter6(Sign Regulations),Subsection
6.08(B)(13),isherebyamendedasfollows:
13.NoA-framesignis permitted anywhere withintheTownof Fountain Hillsafter
December 31,3M4 2015.

SECTION 3.TheZoning Ordinance,Chapter6(Sign Regulations),Subsection
6.08(D)(3),is hereby amended asfollows:
3.Banners,balloonsandpennantsarepermittedforeventssuchasspecialsalesevents
withadvancenotificationtotheTownfornotmorethansixty(60)consecutive
hourspermonth.Theprovisions of thissubsection6.08(D)(3)shallexpireon
December 31,3044 2015.
SECTION4.If anysection,subsection,sentence,clause,phraseorportion of this
Ordinanceisforanyreasonheldtobeinvalidorunconstitutionalbythedecision of anycourt of
competent jurisdiction,suchdecisionshallnotaffectthevalidity of theremainingportions of
this Ordinance.
SECTION 5.TheMayor,theTown Manager,theTown Clerk andtheTownAttorney
areherebyauthorizedanddirectedtoexecutealldocumentsandtakeallstepsnecessarytocarry
outthe purpose and intent of this Ordinance.
