HomeMy WebLinkAboutRes 1994-28\ag§£*/ RESOLUTION NO.1994-28 RESOLUTION OF THE TOWN OF FOUNTAIN HILLS APPROVING THE APPLICATION FOR ARIZONA STATE PARKS BOARD HERITAGE FUNDS OR LAND WATER CONSERVATION FUNDS GOLDEN EAGLE COMMUNITY PARK -PHASE m WHEREAS,the Legislature under ARS §41-503 has authorized the establishment of the Heritage Fund program,providing matching funds to the State of Arizona, its political subdivisions for acquiring lands and developing facilities for public outdoor recreation purposes; and WHEREAS,the Congress under Public Law 88-578 has authorized the establishment of a Federal Land and Water Conservation fund Grant-in-aid Program,providing matching funds to the State of Arizona, its political subdivisions and Indian Tribes for acquiring lands and developing facilities for public outdoor recreation purposes;and WHEREAS,the Arizona State Parks Board (ASPB)is responsible for the administration of the program within the State,setting up necessary rules and procedures governing application by local agencies under the program;and WHEREAS,said adopted procedures established by ASPB require the Applicant to certify by resolution the approval of applications, signature authorization, the availability of local matching funds, and authorization to sign a Participant Agreement with ASPB prior to submission of said applications to ASPB;and WHEREAS,the proposed project must be consistent with the Arizona State Comprehensive Outdoor Recreation Plan;and WHEREAS,the project must be compatible with the land use plans of the applicant; NOW,THEREFORE,BE IT RESOLVED that the Town of Fountain Hills hereby: 1. Approves the filing of an application for Arizona Heritage Fund or Land and Water Conservation Fund assistance;and 2.Certifies that the Town of Fountain Hills will comply with all appropriate state and federal regulations, policies, guidelines, and requirements as they relate to the application; and 3. Certifies that the Town of Fountain Hills has matching funds in the amount of $439,950 from the following sources: Fountain Hills General Fund; and can finance 100 percent of the project, half of which will be reimbursed by an ArizonaState Parks BoardHeritage grant orLand and Water Conservation fund grant; and w 4.Certifies that the Town of Fountain Hills has the non-project surcharge notto exceed ten percent of total project costs which will be paid to ASPB upon AORCC approval of said application,if it is selected for LWCF assistance;and 5. Certifies that the project is compatible with the land use plans of the Town of Fountain Hills;and 6.Certifies thattheprojecthasbeenreviewedbytheparks maintenance and operations staff of theTown of Fountain Hills and that theTown agrees to properly maintain this project;and 7. Appoints the Town of Fountain Hills' Director of Parks and Recreation as agent of the Town of FountainHills toconductall negotiations,execute andsubmitall documents including butnot limited to applications,agreements,amendments,billing statements,and so on which may be necessary for the completion of the aforementioned project.
