A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF
THE TOWN OF FOUNTAIN HILLS,ARIZONA TO APPROVE
TRANSPORTATION PROJECTS FROM AN APPROVED
REGIONAL TRANSPORTATION IMPROVEMENT PROGRAM
FOR WHICH AIR QUALITY CONFORMITY HAS BEEN
DETERMINED.
WHEREAS,under Federal regulations (Title 40,Part 51,Section 450)indicates that:"No
recipient of federal funds designated under Title 23 U.S.C.or the Federal Transit
Act shall adopt or approve a regionally significant highway or transit project,
regardless of funding source,unless there is a current conformity transportation
plan and TIP;"and
WHEREAS,fiscal years 1994 through 1996 ofthe Maricopa Association of Governments Fiscal
Year 1994-1998 Transportation Improvement Program were approved by the
Arizona Department of Transportation;and
WHEREAS,the U.S.Department of Transportation on September 28,1993 made a finding of
conformity for the Maricopa Association of Governments Fiscal Year 1994-1998
Transportation Improvement Program and Long Range Transportation Plan; and
WHEREAS,the Maricopa Association of Governments in July 1994 adopted conformity
procedures which identify conditions under which a project is considered to be
approved for conformity purposes;and
WHEREAS,sufficient funds are available to complete the projects contained in the Maricopa
Association of Governments Fiscal Year 1994-1998 Transportation Improvement
Program forimplementation by the Town of Fountain Hills during fiscal years 1994
through 1996,as listed in Attachment A hereto;and
WHEREAS,within three years of this date,the projects listed in Attachment A hereto are
expected to be under construction,or under contract for construction.
NOW THEREFORE,be it resolved by the Major and Common Council of the Town of Fountain
Hills,Arizona,as follows:
SECTION 1.That the projects contained in the Maricopa Association of Governments Fiscal
Year 1994-1998 Transportation Improvement Program for implementation by the
Town of Fountain Hills,as listed in Attachment A hereto,are approved for
conformity purposes.

SECTION 2.That the Town of Fountain Hills commits that it will inform the Maricopa
Association of Governments immediately in the event that there are significant
changes in the concept scope or design of regionally significant highway or transit
projects in the Maricopa Association of Governments Fiscal Year 1994-1998
Transportation Improvement Program and Long Range Transportation Plan 1993
Update,recognizing that the conformity status could be invalidated for any project
which experiences such changes.
PASSED AND ADOPTED this 3rd day of November,1994.
