RESOLUTION NO.1994-56
A RESOLUTION OF THE MAYOR AND COMMON COUNCIL
OF THE TOWN OF FOUNTAIN HILLS,ARIZONA;
ADOPTING A UNIFORM BOND,PENALTY AND DIVERSION
FEE SCHEDULE FOR THE MUNICIPAL COURT.
WHEREAS,The Town of FountainHills has an established bond,penalty, and diversion
fee schedule;and
WHEREAS,each and every municipality in Maricopa County has an established bond
schedule and said schedules vary greatly as to amounts; and
WHEREAS,in the interestof fairnessand of enhancingthe imageof the CriminalJustice
System and the Courts;
NOW,THEREFORE,BE IT RESOLVED that the Town of Fountain Hills adopts the
attached uniform bond, penalty and diversion fee schedule for use in theFountain Hills Municipal
Court.

subject-uniform BOND SCHEDULE TASK FORCE RECOMMENDATIONS
PURPOSE
The purpose of this memorandum is to recommend the adoption of a uniform bond schedule for
use by the limited jurisdiction courts within Maricopa County, the establishment of presumptive
sanctions (civil traffic fines)for individuals who elect to mail in their sanctions for civil traffic
offenses,and the establishment of a presumptive fee for the Defensive Driving Program.
BACKGROUND
The community in which many Maricopa County residents travel as a routine part of their daily
C schedules typically extends beyond the jurisdictional boundaries of a single limited jurisdiction
court. Many people who residein our county live in one city, while working in another.They may
shop, dine out or visit friends in still a third. Even while remaining in one city, residents may drive
on one of the freeways, essentially leaving the jurisdiction of the municipal court and yielding
themselves to the jurisdiction of one of the justice of the peace courts should they happen to be
cited for a traffic violation.
To the extent that the various limited jurisdiction courts within Maricopa County impose
substantially different bonds for the same or similar offenses,or to the extent that the various
limited jurisdiction courts treat uniform traffic violations in a different manner by imposing
substantially different fines without offering a clear and acceptable explanation for those
differences,the inherent fairness of the limited jurisdiction courts within Maricopa County are
called into question.The potential for negatively impacting public perception of the courts'fairness
is even greater for those courts whose jurisdictional boundaries are adjacent to one another.
A review of the criminal bond schedules and civil traffic sanction amounts used by limited
jurisdiction courts within Maricopa County reveals that there is substantial variation among the
courts. It is because of this variation that you appointed a task force of limited jurisdiction judges
to review the various bond schedules and minor traffic sanction amounts to determine if there was
agreement as to uniform bond amounts for misdemeanor offenses and/or civil traffic sanction
amounts.

by the presiding judges at the next Presiding Judges'meeting,scheduled for September 2,1994.

PRESUMPTIVE DEFENSIVE DRIVING PROGRAM FEE
STATEMENT OF INTENT
1.The presiding judges of limited jurisdiction courts within Maricopa County retain authority
within their courts to set fine amounts for civil traffic offenses.This statement is not
intended to limit or extend that authority.
2.Nevertheless,the presiding judges of limited jurisdiction courts within Maricopa County also
recognize that public perception of the criminal justicesystem and, more specifically,the
courts,can be enhanced by ensuring greater consistency in the setting of bond amounts for
the same or similar criminal offenses and in the imposition of sanctions for civil traffic
offenses by the limited jurisdiction courts within Maricopa County.
3.In the absence of localcommunity concerns which may justify alternative fines, the
presiding judges of limited jurisdiction courts within Maricopa County agreeto voluntarily
structure bonds,civil traffic sanctions and the DDP fee to conform with this schedule,
effective January 1,1995.
4.This schedule will be reviewed bya task force appointed bythe Presiding Judge of
Maricopa County on an annual basis to determine ifthere should be any recommended
changes to this schedule.
UNIFORM BOND SCHEDULE
Class 1 Misdemeanors $500
Class 2 Misdemeanors $350
Class 3 Misdemeanors $150
Itis recognized that judges in individual cases mayset bond amounts that vary substantially
from these uniform bond amounts,based upon the particular facts of each individual case
before them. These bond amounts are to be used for those defendants electing to post
bond after being booked into jail,in lieu of appearing before a judge. These bond amounts
include all applicable surcharges.This statement recognizes as paramount,the
constitutional mandate that,in all cases,the purpose of a bond is to guarantee the
subsequent appearance of the defendant for a court proceeding.

PRESUMPTIVE SANCTIONS FOR CIVIL TRAFFIC OFFENSES
These presumptive sanction amounts (excluding mandatory sanction amounts)include a
range of plus or minus 20%.It is anticipated that over time,individual courts will consider
narrowing the range as these presumptive sanction amounts are reviewed for possible
changes.These sanction amounts are those that appear on a payment card or envelope for
those individuals who elect to mail in their sanction without appearing before a judge or
hearing officer and includes applicable surcharges.
Civil traffic offenses with minimum mandatory sanction amounts,which do not require .an
appearance before a judge,will state the minimum mandatory amount.
Civil traffic offenses were divided into four categories:
*Offenses with minimum mandatory sanctions Minimum mandatory amount
*Moving traffic offenses $90
(+.20%-this allows a range from $72 to $108).
*Non-moving traffic offenses $60
(+_20%-this allows a range from $48 to $72).
*Speeding:
1 - 9 mph over $90
10-15 mph over $100
16-20 mph over $120
More than 20 mph over must appear before a judge (these
are also subject to +.20%)
PRESUMPTIVE DEFENSIVE DRIVING PROGRAM FEE
The presumptive DDP fee is $80 with a 20%variance above or below the presumptive
amount.
