RESOLUTION 1994-59
A RESOLUTION OF THE MAYOR AND COMMON COUNCIL
OF THE TOWN OF FOUNTAIN HILLS,ARIZONA
AUTHORIZING THE ACCEPTANCE OF A GIFT DEED TO
LAND AND REAL PROPERTY LOCATED IN THE TOWN OF
FOUNTAIN HILLS AND CURRENTLY OWNED BY THE
SUNSET KIWANIS CLUB;AUTHORIZING AND DIRECTING
THE MAYOR AND THE TOWN CLERK TO EXECUTE ALL
DOCUMENTS AND TAKE ALL ACTIONS NECESSARY TO
ACCEPT THE GIFT INCLUDING BUT NOT LIMITED TO
ESCROW FEES,TITLE INSURANCE AND RECORDING
COSTS.
WHEREAS,the Sunset Kiwanis Club of Fountain Hills owns certain land and
buildings within the Town of Fountain Hills and more particularly described herein;
and
WHEREAS,it is the intention of the Sunset Kiwanis Club to donate this land and
building to the Town of Fountain Hills in order to expand its availability and use to all
residents;and
WHEREAS,it is the intention of the Town Council to accept the offer of gift from
the Sunset Kiwanis Club;and
WHEREAS,the Town Council has previously approved the execution of a lease
management agreement to allow the Sunset Kiwanis Club to continue to serve the
community through the use of the land and buildings.
NOW,THEREFORE,BE IT ORDAINED BY THE MAYOR AND COMMON
COUNCIL OF THE TOWN OF FOUNTAIN HILLS AS FOLLOWS:
Section 1.That the Town of Fountain Hills accepts the gift of certain land and building
located within the Town of Fountain Hills and more particularly described in the legal
description marked as Exhibit A and included herein by reference.
Section 2.That the Mayor and Town Clerk are hereby authorized and directed to sign
and execute any and all documents necessary for the acceptance of this gift.
Section 3.That the Mayor and Town Clerk are hereby authorized and directed to
expend such sums as are necessary to pay for the preparation of the documents of the
gift including but limited to title insurance and recording fees.
