RESOLUTION 1995-52
ARESOLUTIONOF THE MAYOR AND COMMON COUNCIL OF
THE TOWNOFFOUNTAIN HILLS,ARIZONA ABANDONING
WHATEVERRIGHT,TITLE,OR INTEREST IT HASINAPORTIONOF
THE CERTAIN DRAINAGE AND PUBLIC UTILITY EASEMENTS
ALONG THE SOUTHWESTERLY AND SOUTHEASTERLY LOT LINES OF
LOT 3,BLOCK7,OF PLAT 206 FOUNTAIN HILLS,ARIZONA,AS
RECORDED IN BOOK147OFMAPS,PAGE2,RECORDSOF
MARICOPA COUNTY,ARIZONA.
WHEREAS,The Town Councilof the Town of Fountain Hills,as the governingbodyof
real property located in the TownofFountain Hills,may require the
dedication of public streets,sewer,water,drainage,and other utility
easements or rights-of-way within any proposed subdivision;and
WHEREAS,The Town Councilof the Town ofFountain Hills has the authorityto accept
or reject offersof dedication of private property by easement,deed,
subdivision,plat or other lawful means;and
WHEREAS,All present utility companies have received notification of the proposed
abandonment;
NOW THEREFORE,be it resolved by the Mayor and Common Council of the Townof
Fountain Hills,Arizona as follows:
SECTION 1.That those certain five(5)foot public utility and drainage easements,
located along the southeasterly property line and ten (10)foot located
along the southwesterly property line of Plat 206,Block7,Lot3,Fountain
Hills,Arizona;as recorded in book 147 of maps,page 2 records of Maricopa
County,Arizona;is hereby declared to be abandoned by the Town of
Fountain Hills,except fora one (1)foot drainage easement to be retained
along the southwesterly property line.
SECTION 3.That this Resolution is one of abandonment and disclaimer by the Town
solely for the purpose of removing any potential cloud on the title to said
property and that the Town in no way attempts to affect the rights of any
private party to oppose the abandonment or assert any right resulting
therefrom or existing previous to any action by the Town.
