RESOLUTION 1995-65
A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF
FOUNTAIN HILLS,ARIZONA RELATING TO THE POSSIBLE
ALIGNMENT/INSTALLATION OF A69 KVh ELECTRIC LINE ADJACENT TO THE
TOWN OF FOUNTAIN HILLS EASTERN BORDER ON FORT MCDOWELL INDIAN
TRIBAL LAND.
WHEREAS,Salt River Project is desirous of locating a69KVh electric line east of Fountain Hills on Fort
McDowell Tribal land;and
WHEREAS,residents of Fountain Hills have a significant interest in where that line would be located;and
WHEREAS,theFortMcDowellIndian community hasanintentto provide reliable12KVhelectricpower
toits children's daycare center nowunder construction;and
WHEREAS,theFountainHillsTownCouncilrecognizesthe sovereignty of theFortMcDowellIndian
nationandtheirabilitytomake determinations of whereelectriclines are locatedonTriballand,solelyand
completely byits own authority;and
WHEREAS,the Fountain Hills Town Council wishestoworkwiththe Fort McDowell Indian community
forandon behalf of itscitizenstothe extent possible inmatterssuchasthelocationofelectriclines;and
WHEREAS,theTownofFountainHills receiving allocationsof aesthetic fundsfrom Salt RiverProject
topayfor undcrgrounding of electric lines;and
WHEREAS,theFountainHillsTownCouncilwishesto provide appropriate assistance totheIndian
community,bothfinancialandotherwise,toaidthemintheachievementofmutuallybeneficialgoals;
NOW THEREFORE BEIT RESOLVED,thattheMayorandTownManageroftheTownofFountain
HillsarcherebyempoweredandauthorizedtousetheTown's allocation ofSaltRiverProjectaestheticfundsto
accomplish the undcrgrounding ofa12KVhlineasshownonthemapincludedasExhibitAofthis resolution,if
theFortMcDowellIndianTribewouldagreenottoplacea69KVhlineabovegroundintheareashownonthemap
in Exhibit A.
BE IT FURTHER RESOLVED,thattheMayorandtheTownManagerarealsoempoweredand
authorizedtosignan appropriate agreement(s)tofulfillthegoalsofthisresolution.
