A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF
THE TOWN OF FOUNTAIN HILLS,ARIZONA EXEMPTING THE TOWN
OF FOUNTAIN HILLS FOR 1995 AND1996FROM A.R.S.§9-
500.04,REQUIRING PROGRESSIVE INCREASE INTHEUSEOF
ALTERNATIVE FUEL.
WHEREAS,The Town Council of the Town of Fountain Hills has considered the
requirements outlined in A.R.S.§9-500.04,pertaining to development and
implementation ofa vehicle fleet plan for the purpose of encouraging and
progressively increasing the use of alternative fuels in Town owned vehicles;
and
WHEREAS,TheTown Council of the Townof Fountain Hills has the authority to waive
the requirements on receipt of evidence acceptable to the Town Council
that the Town is unable to acquire or be provided equipment orrefueling
facilities necessary to operate vehicles using alternative fuels at a projected
cost that is reasonably expected to resultin net costs of no greater than ten
per cent more than the net costs associated with the continued use of
traditional gasoline or diesel fuels measured over the expected usefullife
of the equipment or facilities supplied;and
WHEREAS,The Town Council has acceptable evidence described above,
NOW THEREFORE,be it resolved by the Mayor and Common Council of the Town of
Fountain Hills,Arizona as follows:
TheTownof Fountain Hills is exempt from the requirements of A.R.S.§9-
500.04 for the years 1995 and 1996.
PASSED AND ADOPTED this 21st day of December,1995.
