PO Box 17958 Fountain Hills,AZ 85269 RESOLUTION 1997-54 A RESOLUTION OFTHE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS,ARIZONA PURSUANT TO A.R.S. §28-7201 ET.SEQ.ABANDONING TO THE ADJACENT PROPERTY OWNERS ALLRIGHT,TITLE OR INTERESTIN CERTAIN PUBLIC RIGHTS-OF-WAY LOCATED WITHIN THE AREA COMMONLY KNOWN AS SAGUARO WOODS (FONTANA II,BLOCK 1FINAL PLATNUMBER 110)AS RECORDED IN BOOK 159 OF MAPS,PAGE 42 AND CORRECTEDIN BOOK 168OF MAPS,PAGE 28 AND HORIZONTAL PROPERTY REGIME AS RECORDED IN BOOK 160 OF MAPS,PAGE 4OFTHE RECORDS OFTHE MARICOPA COUNTY RECORDER WHICH HAVE FOUND TOBE NO LONGER NECESSARY FOR PUBLIC USE. WHEREAS,A.R.S.§28-7201 et.seq.provides for the disposition of unnecessary public roads;and WHEREAS,TheTown Council of the Townof Fountain Hills is the governing body of the Town;and NOW THEREFORE,be it resolved by the Mayor and Common Council of the Town of Fountain Hills,Arizona,as follows: SECTION 1.That the right-of-way for Boxwood,Oakwood and Teakwood,originally private roads whose centerline is as shown inBook160of maps,Page 4; together with Parcels Al,A2,A3,Bl,and B2 dedicated inDkt 13442,Page 1524,Maricopa County Records as depicted in"ExhibitA"attached hereto and incorporated herein is hereby declared to be no longer necessary for public use as right-of-way. SECTION 2.That the Council determines this property can best be used to protect the public health,safety and welfare of the adjacent property owners and the citizens of the Town and therefore declares that the value of the property is de minimis and that no compensation is required from the adjacent property owners pursuant to A.R.S.§28-7208. SECTION4.That a public utility easement and emergency access easement shall be retained,as depicted in Exhibit A,attached hereto. PASSED AND ADOPTED this 6th day of October,1997.
