RESOLUTION DECLARING THE RESULT OF,AND ADOPTING A CERTIFICATE OF
RESULT OF,THE SPECIAL BOND ELECTION HELD ON NOVEMBER 4,1997;
ORDERING THE RECORDING OF SUCH CERTIFICATE AND DECLARING AN
EMERGENCY.
BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HELLS,ARIZONA,as follows
Section 1.Aftercarefulexamination of the official returns of thespecialbondelection
heldinandfortheTown of Fountain Hills onNovember4,1997,itisfoundand determined bythe
Mayor andCouncilasfollows:
(A)Amajority of those qualified electorsvotingattheaforementionedspecialbond
election voted "BondsYes"asshownonthe attached Certificate ofResult ofElection;
(B)TheMayorandmembers ofthisCouncilpresentthisdatewillexecutetheattached
Certificate ofResult ofElection;
(C)TheClerkisherebydirectedtorecordtheattachedCertificate of Result of
Electionintheoffice of theCountyRecorder of MaricopaCounty,Arizona,andtoreturnsaidcopy
withtherecordingdatashownthereontothe official records of thisbody.
Section 2.Theimmediateoperation of theprovisions of thisresolutionisnecessary
forthepreservation of thepublicpeace,healthandsafetyandanemergencyisherebydeclaredtoexist,
andthisresolutionwillbeinfullforceandeffectfromandafteritspassageandapprovalbytheMayor
andCouncilasrequiredbylawanditisherebyexemptfromthe referendum provisions of the
Constitution and laws ofthe State of Arizona.
PASSED AND ADOPTED bythe Mayor andCouncil of the Town of Fountain Hills,
Arizona,on November 18,1997.

TheMayorandCouncil of theTown of Fountain Hills,Arizona,herebycertifyas
f 1.Pursuant to the resolution passed and adopted by the Mayor and Council on
\^z June19,1997,anelectionwasdulyandregularlyheldonNovember4,1997,forthepurpose of
approvingtheissuanceandsale of bondsinthetotalprincipalamount of $6,000,000toprovidefunds
toacquirelandforopenspacepreserves,parks,trailsandrecreationalpurposesandtopayall
environmental,financial,legal,engineeringandothercostsinconnectiontherewith.
2.The election had been conducted and the official returns thereof have been filed as
requiredbylawandthatthetotalnumber of votescastatthespecialbondelectioninanswertothe
questionsubmittedwereasfollows:

Thetabulatedvotesforthebondquestionissetforthintheattachedfinalcumulativereport.
3.Eachandeverypersonwhovotedatthespecialbondelectionwasaqualifiedelector

4.Themajority of thevotescastattheelectionwereinfavor of thisCouncilincurring
indebtedness of theTowninthetotalauthorizedprincipalamount of $6,000,000bytheissuanceand
sale of all ofthebondsdescribedinthequestion.

HTLLS,ARIZONA,ON NOVEMBER 4,1997
WHEREAS,atthespecialbondelectionheldinandfortheTown of Fountain Hills,
Arizona(the"Town"),onNovember4,1997,voting machines wereusedbytheTownto evidence the
respectivevotes of those qualified electorsvotingatsuchelection;and
WHEREAS,the Maricopa CountyElections Department aidedtheTownin
tabulating the votes cast;and
WHEREAS,theundersignedactedasthepersonresponsibleforthecorrectcounting
oftheballotscastattheabove-mentionedspecialbondelection;and
WHEREAS,Ihavecausedthevotetabulatingequipmenttocounttheballotssoasto
showthereturnsforeachpoll,allasshownontheattachedreturn;and
