A RESOLUTION OF THE MAYOR AND COMMON
COUNCILOFTHE TOWN OFFOUNTAINHILLS,
ARIZONA ABANDONING WHATEVER RIGHT,TITLE,OR
INTEREST IT HAS IN PORTIONS OF CERTAIN PUBLIC
UTILITY AND DRAINAGE EASEMENTS IN PLAT 112,
FOUNTAIN HILLS,ARIZONA.
WHEREAS,TheTownCounciloftheTownofFountain Hills,as thegoverningbodyof
realpropertylocatedintheTownofFountain Hills,mayrequirethe
dedicationof public streets,sewer,water,drainage,andother utility
easements or rights-of-way within any proposed subdivision;and
WHEREAS,TheTown Council oftheTownofFountain Hills hastheauthorityto accept
orrejectoffersof dedication ofprivate property by easement,deed,
subdivision,plat or other lawful means;and
WHEREAS,All present utility companies have received notificationofthe proposed
abandonment;
NOW THEREFORE,be it resolved by the Mayor and Common Council of the Town of
Fountain Hills,Arizona as follows:
SECTION 1.That portions of the certain public utility and drainage easements onthe
followinglots,as shown in the attached ExhibitA,in Plat 112,as recorded
inthe records ofMaricopaCounty,Arizona;are hereby declared tobe
abandoned by the Town of Fountain Hills.

SECTION 2.That this Resolution is one of abandonment and disclaimer bytheTown
solely for the purpose of removing any potential cloud on the titleto said

therefrom or existing previous to any action by the Town.
