TOWN OF FOUNTAIN HILLS
RESOLUTION 1998-16
A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS,MARICOPA COUNTY,ARIZONA,
AMENDING THE GENERAL PLAN OFTHE TOWN OF FOUNTAIN HILLS,
ARIZONA TO ADOPT THAT CERTAIN DOCUMENT KNOWN AS THE
MARCH 12,1998 DRAFT GENERAL PLAN OF THE TOWN OF FOUNTAIN
HILLS,ARIZONA.
WHEREAS,The Town of Fountain Hillsis located in Maricopa County,Arizona;and
WHEREAS,Title9,Section 461.05ofthe Arizona Revised Statutes requirestheTownto
prepare andadopta comprehensive,long-range general plan containing alanduse
element anda circulation element forthe development of the Town;and
WHEREAS,TheTown of Fountain Hills adopted TheFountainHillsGeneralPlan onMay6,
1993 withthe adoption of Resolution 1993-15;and
WHEREAS,The Town of Fountain Hills has prepared TheMarch 12,1998 DraftFountain
Hills General Plan which contains a land use element,a circulation element,a
parks,recreation,and open space element,andan economic development element;
and
WHEREAS,The Town of Fountain Hills solicited review comments from Maricopa County,
Salt River Pima Maricopa Indian Community,Fort McDowell Indian Reservation,
Cityof Scottsdale,Maricopa Association of Governments,the Arizona Department
of Commerce andthe Arizona State Land Department from October 3,1997 to
December 3,1997;
WHEREAS,The Town of Fountain Hills advertised with public notices of asizethatwereone-
eighth pageor greater insize,inthe official newspaper ofgeneral circulation,The
Times of Fountain Hills,on February 25,1998,March 4,1998and March 11,
1998forapublic hearing tobeheldbythe Fountain Hills Planning andZoning
Commission on March 12,1998,where comments from the public were invited;
and
WHEREAS,The Fountain Hills Planning and Zoning Commission madeits recommendation
known to the Town Council on March 12,1998;and

WHEREAS,TheTownof Fountain Hills advertised with public notices ofasizethatwereone-
eighth pageor greater insize,inthe official newspaper ofgeneral circulation,The
TimesofFountainHills,onMarch18,1998,March25,1998andApril1,1998
forapublichearingtobeheldbytheFountainHillsTownCouncilonApril2,
1998,where comments from the public were invited;and
WHEREAS,BoththeTownofFountainHillsPlanningandZoningCommissionandthe
FountainHillsTownCouncilhave conducted publichearingsinaccordancewith
the procedures detailed inTitle9,Section 461.06 ofthe Arizona RevisedStatutes;
and
NOW THEREFORE,beit resolved bythe Mayor and Common Council of theTownof
Fountain Hills,Arizona,as follows:
SECTION 1;ThatResolution 1993-15 that adopted The FountainHillsGeneralPlan,including
any successive resolutions thathave amended TheFountainHillsGeneralPlan,
are hereby rescinded.
SECTION 2:That the March 12,1998 Draft of TheFountain Hills GeneralPlan is hereby
adopted as TheFountainHills General Plan.
PASSED AND ADOPTED this 2nd day of April,1998 bythe Mayor and Common Council of
the Town of Fountain Hills,Arizona.
