A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS,ARIZONA,DECLARING A PUBLIC NEED
AND NECESSITY AND A PUBLIC PURPOSE;AUTHORIZING AND
DIRECTING THE TOWN MANAGER,TOWN ATTORNEY,AND TOWN
CLERK TO TAKE ANY AND ALL ACTIONS NECESSARY AND TO SIGN
ANY AND ALL DOCUMENTS AND PAY ANY AND ALL COSTS OR FEES
IN ORDER TO ACQUIRE REAL AND/OR PERSONAL PROPERTY
THROUGH GIFT,PURCHASE,OR EMINENT DOMAIN;IDENTIFYING
THE REAL AND PERSONAL PROPERTY AS OPEN SPACE LANDS OR
OPEN AREAS;AND DECLARING AN EMERGENCY.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF
FOUNTAIN HILLS,ARIZONA,AS FOLLOWS:
Section1.ThatA.R.S.§9-464andA.R.S.§9-464.01 defineopenspacelandsoropenareasas
areascharacterizedbygreatnaturalscenicbeauty,orwhoseexistingopenness,naturalconditionor
present state of theuse would maintain or enhance the conservation or natural or scenic resources,
andthattheacquisitionofinterestsinsaidlandsisapublicpurposeforwhichpublicfundsmaybe
expended or advanced.
Section2.ThattheTownhasidentifiedcertainrealpropertylocatedinSection7ofTownship
3North,Range6East,SRB&M,saidparcel being approximately 15 or20acresinsizeandneeded
forthepurposesof connecting tolargerparcelsrecentlyacquiredforopenspaceconservationbythe
Town of Fountain Hills.
Section3.That theuse of saidreal property foropen space isa public useandinthebest
interests of the citizens of Fountain Hills.
Section 4.That the Town Manager,Town Clerk,and Town Attorney arehereby authorized and
directed to acquire saidreal property bygift,purchase,or imminent domain,andtodoallactsand
tosignall documents andpayall costs necessary to acquire said real property.
Section 5.That the immediate operation ofthe provisions of this Resolution isnecessaryforthe
preservation of the public peace,health,safety and welfare of the citizens,andthatthe Council
therefore declares thatan emergency exists andthatthis Resolution shallbeinfullforceandeffect
fromand after its passage bythe Council as required bylaw.
