RESOLUTION 2000-30
A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS,ARIZONA,AMENDING RESOLUTION NO.
1999-24 BY EXTENDING THE COMPLIANCE DATE FOR AN
INTERGOVERNMENTAL AGREEMENT WITH THE CITY OF
SCOTTSDALE;AND DECLARING AN EMERGENCY
WHEREAS,the Mayor and Council of the Town of Fountain Hills,Arizona adopted Resolution
No.1999-24 on May 20,1999;and
WHEREAS,Section 3.A.3.provided that onor before August 1,2000 the City of Scottsdale and
the Town of Fountain Hills shall have entered into and executed an Intergovernmental Agreement
setting forththedutiesand obligations ofthetwo municipalities with particular attention totheissue
of costs incurred by Fountain Hills inthe formation ofthe District and those issues deemed relevant
bythe respective Councils;and
WHEREAS,the Mayor and Council of the Town of Fountain Hills on August 10.1999 passed
Resolution No.1999-40 approving an Intergovernmental Agreement between the Town ofFountain
Hills andthe City of Scottsdale and forwarded same tothe City of Scottsdale;and
WHEREAS,Section 4 of Resolution 1999-24 provides that the dates of said resolution maybe
modified bytheTown Council of the Town of Fountain Hills,andthat if no modification ismade,
thenthe participation of theTown of Fountain HillsandtheLosArcos Multipurpose Facilities
District shall terminate on August 1,2000.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL
OF THE TOWN OF FOUNTAIN HILLS,ARIZONA,AS FOLLOWS:
Section 1.
That the terms and conditions of Section 3.A.C.of Resolution 1999-24 are hereby
amended to read as follows:
C.That onor before December 1,2000,the City of Scottsdale andthe Town of
Fountain Hills shall have entered into and executed an Intergovernmental
Agreementsettingforththedutiesandobligations of thetwomunicipalities
with particular attention totheissues of thecostsincurredbyFountainHills
in the formation of the District and those issues deemed relevant bythe
respective Councils.

Section 3.
That Section 4 of Resolution 1999-24 is hereby amended toreadasfollows:
That if andinthe event that any of the conditions set forth donot occur onor before
the dates setforth herein,and said dates have not been modified bythe actions of
this Town Council,then the participation of the Town of Fountain Hills intheLos
Arcos Multipurpose Facilities District shall terminate on December 1,2000.
Thatthe immediate operation ofthe provisions of this resolution is necessary forthe
preservation of the public peace,health,safety and welfare of the Town of Fountain
Hills,and an emergency is hereby declared to exist.This resolution shall beinfull
force and effect from and after its passage,adoption and approval bythe Mayor and
Common Council of the Town of Fountain Hills,as failure to adopt this action asan
emergency item jeopardizes the participation of the Town inthe District andhasa
significant economic detriment to the Town.
PASSED AND ADOPTED by the Mayor and Common Council ofthe Town of Fountain Hills,
Arizona,this 6th day of July,2000.
