HomeMy WebLinkAboutRes 2000-53RESOLUTION 2000-53 A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS,ARIZONA,AMENDING RESOLUTIONS 1999-24 AND 2000-30 BY EXTENDING THE COMPLIANCE DATE FOR AN INTERGOVERNMENTAL AGREEMENT WITH THE CITY OF SCOTTSDALE;AND DECLARING AN EMERGENCY. WHEREAS,the Mayor and Council of the Town of Fountain Hills,Arizona adopted Resolution 1999-24 on May 20,1999;and WHEREAS,the Mayor and Council of the Town of Fountain Hills,Arizona adopted Resolution 2000-30 on July 6,2000;and WHEREAS,Section 3,Paragraph 3 of Resolution 1999-24 have been modified to reflect adate of December 1,2000 forthe execution of an Intergovernmental Agreement between theCity of Scottsdale and the Town of Fountain Hills;and that Section 4,of Resolution 1999-24 has been amended to indicate the automatic termination of the Town of Fountain Hills in the Los Arcos Multipurpose Facilities District if the conditions of Section 3.3 above hadnotbeen reached by December 1,2000; NOW,BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS,ARIZONA,AS FOLLOWS: Section 1. That the terms and conditions of Section 3,Paragraph 3 of Resolution 1999-24 arehereby amended to read as follows: 3.That onor before June1,2001,theCity of Scottsdale andtheTown of Fountain Hillsshall have entered intoand executed an Intergovernmental Agreementsettingforththedutiesandobligations of thetwomunicipalities with particular attentiontotheissues of thecostsincurredbyFountainHills in the formation of the District and those issues deemed relevant bythe respective Councils. ThatSection4 of Resolution 1999-24 is hereby amended toreadasfollows: That if andinthe event thatany of the conditions setforthdonot occur on orbeforethedatessetforthherein,andsaiddateshavenotbeenmodifiedby theactions of thisTown Council,thenthe participation of theTown of Fountain HillsintheLosArcos Multipurpose Facilities District shall terminate on June 1,2001. Section 3. Thattheimmediateoperation of theprovisions of this resolution isnecessaryforthe preservation of the public peace,health,safety,and welfare of the Town of Fountain Hills,andan emergency is hereby declared to exist.This resolution shall beinfull force and effect fromand after its passage,adoption,and approval bythe Mayor and Common Council of the Town of Fountain Hills,asfailuretoadoptthisactionasan emergency item jeopardizes the participation of theTown inthe District andhasa significant economic detriment tothe Town.
