RESOLUTION 2001-05
A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS,ARIZONA,ABANDONING WHATEVER
RIGHT,TITLE,OR INTEREST IT HAS IN A PORTION OF THE CERTAIN
PUBLIC INGRESS/EGRESS EASEMENT AND GENERAL EASEMENT
ALONG THE NORTHERLY PORTION OF TRACT D (DESIGNEATED AS
TRACT D-l)FOUNTAIN HILLS,ARIZONA,AS RECORED IN BOOK 336 OF
MAPS,PAGE 01,RECORDS OF MARICOPA COUNTY,ARIZONA.
WHEREAS.TheTownCounciloftheTownofFountainHills,asthegoverningbodyofreal
property located intheTownof Fountain Hills,may require the dedication of
publicstreets,sewer,water,drainage,and other utilityeasementsorrights-of-way
within any proposed subdivision;and
WHEREAS.TheTownCounciloftheTownofFountainHillshastheauthoritytoacceptor
rejectoffersofdedicationofprivatepropertybyeasement,deed,subdivision,plat
or other lawful means,and
NOW THEREFORE,beit resolved bythe Mayor and Common Council of the Town of
Fountain Hills,Arizona as follows:
SECTION 1.Thatthecertainpublic ingress/egress easement andgeneral easement locatedon
the northerly portionof Tract D,and designated as proposed Tract D-l,ofthe
Crossroads Convenience Center plat,shown in Exhibit "A";as recorded in book
336ofmaps,page01recordsof Maricopa County,Arizona;areherebydeclared
tobe abandoned by the Town of Fountain Hills.
SECTION 2.ThatthisResolutionisoneofabandonmentanddisclaimerbytheTownsolelyfor
the purpose of removing any potential cloud onthetitletosaid property andthat
the Town innoway attempts toaffecttherightsofany private party to oppose the
abandonment orassertanyright resulting therefrom or existing previous toany
action by the Town.
