WHEREAS,TheTownCounciloftheTown of FountainHills,asthegoverningbodyofrealproperty locatedintheTownof Fountain Hills,mayrequirethededication of publicstreets,sewer, water,drainage,andotherutilityeasementsorrights-of-waywithinanyproposed subdivision;and WHEREAS,TheTownCounciloftheTown of Fountain Hillshastheauthoritytoacceptorrejectoffers of dedication of private property by easement,deed,subdivision,platorotherlawful means;and NOW THEREFORE,beit resolved bythe Mayor and Common Council of the Town of Fountain Hills, Arizona as follows: SECTION 1.That the drainage easement shown in Exhibit A,located onLot 31 of Plat 606-Amended, FountainHills,Arizona;asrecordedinbook428ofmaps,page50recordsofMaricopa County,Arizona;is hereby declared tobe abandoned bythe Town of Fountain Hills. SECTION 2.ThatthisResolutionisone of abandonment anddisclaimerbytheTownsolelyforthe purpose of removingany potential cloudonthetitletosaid property andthattheTownin nowayattemptstoaffecttherights of anyprivatepartyto oppose the abandonment or assert anyright resulting therefromor existing previous toany action bytheTown.
