NOW THEREFORE,be it resolved by the Mayor and Common Council of the Town of Fountain Hills,Arizona as follows: WHEREAS,The TownCouncilof the Townof Fountain Hills,as the governing bodyofreal property located in the Townof Fountain Hills,may require the dedication of public streets,sewer,water,drainage,and other utility easements,non-vehicular access easements or rights-of-way within any proposed subdivision;and WHEREAS,The TownCouncilof the Townof Fountain Hills,as the governing body ofreal property located in the Townof Fountain Hills,has the authority to abandon utility easements,drainage easements,non-vehicular access easements orrights-of- way within the Town of Fountain Hills;and NOW THEREFORE,be it resolved by the Mayor and Common Council of the Town of Fountain Hills,Arizona as follows: SECTION 1.That portions ofa certain one (1)foot non-vehicular access easement located along the easterly property lineof Tract "G"of the Eagle Mountain Parcel 10/11 Subdivision,Fountain Hills,Arizona;as recorded in Book 436 of maps,Page 32 records of Maricopa County,Arizona,and as more specifically depicted in Attachment "A"hereto,is hereby declared to be abandoned by the Town of Fountain Hills.
