RESOLUTION 2001-55
A RESOLUTION OF THE MAYOR AND COMMON
COUNCIL OF THE TOWN OF FOUNTAIN HILLS,
ARIZONA PURSUANT TO A.R.S.§28-1901 ET.SEP.
ABANDONING ALL RIGHT,TITLE OR INTEREST IN THE
TWO ALLEY RIGHTS-OF-WAYS LOCATED WITHIN
FOUNTAIN HILLS FINAL PLAT NUMBER 302,BLOCK 3,
ADJACENT TO LOTS 1-6 AND ALONG AND ADJACENT
TO PARCEL "C"AS RECORDED IN BOOK 156,PAGE 45
OF THE RECORDS OF THE MARICOPA COUNTY
RECORDER WHICH HAVE BEEN FOUND TO BE NO
LONGER NECESSARY.
WHEREAS,A.R.S.§28-1901 et.seg.providesforthedispositionofunnecessarypublic roads;
and
WHEREAS,TheTownCounciloftheTownofFountainHillsisthegoverningbodyofthe
\^/Town;and
NOW THEREFORE,beit resolved bythe Mayor and Common Council of the Town ofFountain
Hills,Arizona,as follows:
SECTION 1.Thatthe2publicalleyslocatedwithinPlat302,Block,3,Lots1-6asrecordedin
Book 156,Page 45,Maricopa County Recorder Records as described in Exhibit A
attachedheretoandincorporatedhereinareherebydeclaredtobenolonger
necessary for public useasalley right-of-ways.
SECTION 2.ThattheCouncildeterminesthispropertycanbestbeusedtoprotectthepublic
health,safetyand welfare of the adjacent property owners andthecitizensofthe
Town and therefore declares thatthevalueofthe property isde minimis andthatno
compensation is required fromtheadjacent property owners pursuant toA.R.S.§
28-1902.A.3 and §28-1902.A.5.
SECTION 3.ThatuponrecordationofthisresolutionintheofficeoftheMaricopaCounty
Recorder,titletothe alleys as described in Exhibit A shall vest inthe owners of
recordoftheadjacentpropertyas determined bytherecordsofthe Maricopa County
Recorder ontheday of recordation,subject tothe easements retained.
