RESOLUTION 2003-07
A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS,ARIZONA ABANDONING WHATEVER
RIGHT,TITLE,OR INTEREST IT HAS IN A PORTION OF THE CERTAIN
TEN (10')FOOT PUBLIC UTILITY AND DRAINAGE EASEMENTS ALONG
THE NORTHERLY LOT LINE OF LOT 14,BLOCK 6,OF PLAT 603B,
FOUNTAIN HILLS,ARIZONA,AS RECORDED IN BOOK 161 OF MAPS,
PAGE 41,RECORDS OF MARICOPA COUNTY,ARIZONA.
WHEREAS,TheTownCounciloftheTownofFountainHills,asthe governing bodyofrealproperty
locatedintheTownofFountainHills,mayrequirethededicationofpublicstreets,sewer,
water,drainage,andotherutilityeasementsor rights-of-way withinanyproposed
subdivision;and
WHEREAS,TheTownCounciloftheTownofFountainHillshastheauthoritytoacceptorrejectoffers
ofdedicationofprivatepropertybyeasement,deed,subdivision,platorotherlawful
means;and
WHEREAS,Allpresentutilitycompanieshavereceivednotificationoftheproposedabandonment;
NOW THEREFORE,beitresolvedbytheMayorandCommonCouncil of theTown of Fountain Hills,
Arizona as follows:
SECTION 1 Thataportionofthecertainten(10)footpublicutilityanddrainageeasements,located
alongthe northerly property lotline of Plat 603B,Block 6,Lot 14,Fountain Hills,Arizona;
asshowninExhibit"A";asrecordedinbook161ofmaps,page41recordsofMaricopa
County,Arizona;areherebydeclaredtobe abandoned bytheTown of Fountain Hills.
Certainlotswithinthissubdivisionaresubjecttolot-to-lotdrainagerunoff.Theproperty
ownerofLot14isrequiredtopassthedevelopedflowsgeneratedbytheupstreamlots
across their property.
SECTION 2.ThatthisResolutionisoneofabandonmentanddisclaimerbytheTownsolelyforthe
purpose of removinganypotentialcloudonthetitletosaidpropertyandthattheTownin
noway attempts toaffecttherights of any private partyto oppose the abandonment or
assert any right resulting therefromor existing previous toany action bythe Town.
