RESOLUTION 2003-15
A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS,ARIZONA ABANDONING WHATEVER
RIGHT,TITLE,OR INTEREST IT HAS IN A PORTION OF THE CERTAIN
TEN (10')FOOT PUBLIC UTILITY AND DRAINAGE EASEMENTS ALONG
THE NORTHERLY LOT LINE OF LOT 9,BLOCK 2,OF PLAT 505C,
FOUNTAIN HILLS,ARIZONA,AS RECORDED IN BOOK 158 OF MAPS,
PAGE 42,RECORDS OF MARICOPA COUNTY,ARIZONA.
WHEREAS,The Town Council of theTown of Fountain Hills,asthegoverningbody of realproperty
locatedinthe Town of Fountain Hills,may require the dedication of publicstreets,sewer,
water,drainage,andotherutility easements orrights-of-waywithinanyproposed
subdivision;and
WHEREAS,The Town Council of theTown of Fountain Hillshastheauthoritytoacceptorrejectoffers
of dedication of privatepropertyby easement,deed,subdivision,platorotherlawful
means;and
WHEREAS,All present utility companies have received notification of the proposed abandonment;
NOW THEREFORE,beit resolved bythe Mayor and Common Council of the Town of Fountain Hills,
Arizona as follows:
SF.CTTON 1 Thata portion of thecertainten(10)footpublicutilityanddrainage easements,located
alongthewesterlypropertylotlineofPlat505C,Block2,Lot9,FountainHills,Arizona;
as shown in Exhibit "A";as recorded inbook158 of maps,page42 records of Maricopa
County,Arizona;arehereby declared tobe abandoned bythe Town of Fountain Hills.
Certain lots within this subdivision are subject to lot-to-lot drainage runoff.Theproperty
owner of Lot9isrequiredtopassthe developed flowsgeneratedbytheupstreamlots
across their property.
SECTION 2.That this Resolution isone of abandonment and disclaimer bythe Town solely forthe
purposeofremovinganypotentialcloudonthetitletosaidpropertyandthattheTownin
noway attempts to affect therights of any private party to oppose the abandonment or
assertanyrightresultingtherefromorexistingprevioustoanyactionbytheTown.
