A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF
FOUNTAIN HILLS,ARIZONA ABANDONING WHATEVER RIGHT,
TITLE,OR INTEREST IT HAS IN A PORTION OF THE CERTAIN TEN
(10')FOOT PUBLIC UTILITY AND DRAINAGE EASEMENTS ALONG
THE SOUTHERLY LOT LINE OF LOT 5,BLOCK 4,OF PLAT 604B AND
ALONG THE NORTHERLY LOT LINE OF LOT 8,BLOCK 2,OF PLAT
605D,FOUNTAIN HILLS,ARIZONA,AS RECORDED IN BOOK 196 OF
MAPS,PAGE 27 AND BOOK 164 OF MAPS,PAGE 15 RESPECTIVELY,
RECORDS OF MARICOPA COUNTY,ARIZONA.
WHEREAS,the Mayor and Council of the Town of Fountain Hills(the 'Town Council"),
asthegoverningbodyofrealpropertylocatedintheTownofFountainHills(the "Town"),may
requirethededicationofpublicstreets,sewer,water,drainage,andotherutilityeasementsorrights-
of-way withinany proposed subdivision;and
WHEREAS,the Town Council hasthe authority to accept or reject offers of dedication of
privatepropertybyeasement,deed,subdivision,platorotherlawfulmeans;and
WHEREAS,all present utility companies have received notificationofthe proposed
abandonment.
NOW THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE
TOWN OF FOUNTAIN HILLS,as follows:
SECTION 1.Thataportionofthecertainten(10)footpublicutilityanddrainage
easements,generallylocatedalongthesoutherlypropertylotlineofPlat604B,Block4,Lot5,
Fountain Hills,as recorded in book 196ofmaps,page27 records of Maricopa County andalong
thenortherlylotlineofPlat605D,Block2,Lot8,FountainHills,asrecordedinbook164ofmaps,
page15recordsofMaricopaCountyandmoreparticularlydescribedinExhibitA,attachedhereto
andincorporatedhereinbyreference,areherebydeclaredtobeabandonedbytheTown.Certain
lotswithinthissubdivisionaresubjecttolot-to-lotdrainagerunoff.ThepropertyownersofLots5
and8arerequiredtopassthedevelopedflowsgeneratedbytheupstreamlotsacrosstheir property.
SECTION ?..That this Resolution is one of abandonment and disclaimer bythe Town
solelyforthepurposeofremovinganypotentialcloudonthetitletosaidpropertyandthatthe
Towninnowayattemptstoaffecttherightsofanyprivatepartytoopposetheabandonmentor
assertanyrightresultingtherefromorexistingprevioustoanyactionbytheTown.
