RESOLUTION 2003-36
A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS,ARIZONA,ABANDONING WHATEVER
RIGHT,TITLE,OR INTEREST IT HAS INA PORTION OF THE
CERTAIN TEN (10>)FOOT PUBLIC UTILITY AND DRAINAGE
EASEMENTS ALONG THE WESTERLY LOT LINE OF LOT 27,BLOCK
2,OF PLAT 505C,FOUNTAIN HILLS,ARIZONA,AS RECORDED IN
BOOK 158 OF MAPS,PAGE 42,RECORDS OF MARICOPA COUNTY,
ARIZONA.
WHEREAS,theMayorandCounciloftheTownof Fountain Hills(the 'Town Council"),
asthegoverningbodyofrealpropertylocatedintheTownofFountainHills(the 'Town"),may
requirethededicationofpublicstreets,sewer,water,drainage,andotherutilityeasementsorrights-
of-waywithinany proposed subdivision;and
WHEREAS,the Town Council hasthe authority to accept or reject offers of dedication of
privatepropertybyeasement,deed,subdivision,platorotherlawfulmeans;and
WHEREAS,allpresentutilitycompanieshavereceivednotificationoftheproposed
abandonment.
NOW THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE
TOWN OF FOUNTAIN HILLS,as follows:
SFCTTON 1 That aportion of thecertainten(10)foot public utilityanddrainage
easements,located alongthe westerly property lotline of Plat 505C,Block 2,Lot27,Fountain
Hills,as recorded in book 158 of maps,page42 records of Maricopa County,andasmore
particularlydescribedinExhibitA,attachedheretoandincorporatedhereinbyreference,arehereby
declared tobe abandoned bytheTown.Certain lotswithinthis subdivision are subject tolot-to-lot
drainagerunoff.ThepropertyownerofLot27isrequiredtopassthedevelopedflowsgeneratedby
the upstream lotsacross their property.
SF.CTTON 1.That this Resolution is one of abandonment and disclaimer bythe Town
solelyforthepurposeofremovinganypotentialcloudonthetitletosaidpropertyandthatthe
Towninnowayattemptstoaffecttherightsofanyprivatepartytoopposetheabandonmentor
assertanyrightresultingtherefromorexistingprevioustoanyactionbytheTown.
