RESOLUTION 2002-04
A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS,ARIZONA,PURSUANT TO THE
ARIZONA CONSTITUTION,ARTICLE IX,SECTION 20,SUBSECTION
9 AND A.R.S.§41-563.03.AND A.R.S §42-17056 DESIGNATING AN
ELECTION DATE AND AUTHORIZING AND DIRECTING TOWN
STAFF TO DO ALL ACTIONS AND TAKE ALL STEPS NECESSARY
FORTHE INCLUSION ONTHE MAY 21st,2002 GENERAL ELECTION
OF TWO BALLOT QUESTIONS,THE FIRST BEING AN INITIAL BASE
LEVY OF PRIMARY PROPERTY TAX IN THE AMOUNT OF
$2,400,000.00 AND THE SECOND QUESTION BEING A PERMANENT
ADJUSTMENT OF EXPENDITURE LIMITATION OF THE TOWN
FROM $14,554,855.00 TO $20,500,000.00;AND DESIGNATING THE
DEADLINE FOR VOTER REGISTRATION.
WHEREAS,In 1980 the voters of the state of Arizona amended the Arizona
Constitution Article IX,Section 20to require expenditure limitations forall cities and towns in
the state of Arizona;and,
WHEREAS,pursuant tosaid constitutional amendment thestate legislature enacted
A.R.S.§41-563.03settingforththeform of ballotfora permanent adjustment of theexpenditure
limitation;and,
WHEREAS,thestate legislature inA.R.S.§42-17056 setforththe procedure forthe
approval by voters of a primary property taxinacityortown;and,
WHEREAS,itisthefinding of this Council that questions should be presented tothe
qualified electors ofthe Town of Fountain Hills atthe general election called for May 21st,2002;
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMON
COUNCIL OF THE TOWN OF FOUNTAIN HILLS,ARIZONA,AS FOLLOWS:
Section 1.That pursuant to Article IX,Section 20,Subsection 9 of the Arizona Constitution
andA.R.S.§41-563.03,Staff isdirectedtotakeallstepsandtodoallactions
necessary tonotifythe Maricopa County Elections Department thataballot
question seeking voterapproval of a permanent adjustment tothe expenditure
limit base of the Town of Fountain Hills fromits current $14,554,855.00 toanew
level of $20,500,000.00 be presented tothe qualified electors of the Town,atthe
May 21st,2002 election.
Section 2.That pursuant toA.R.S.§42-17056 thatthe question of a primary property tax
levyinan amount necessary toraise $2,400,000.00 foruseinthegeneralfundof
the Town for expenditures in connection with public safety specifically fireand
emergency medicalservicesbe presented tothe qualified electors of theTown;at
theMay 21st,2002 election.

Section3.ThattheTownOfficersareauthorizedanddirectedtodoallacts,signall
documentsandexpendallfundsnecessaryincludingtheproductionand
distribution of mandated publicitypamphletsandotheritemsfor compliance with
federal and state election laws.
PASSED AND ADOPTED bythe Mayor and Common Council of the Town of
Fountain Hills,Arizona this 17th day of January,2002.
