RESOLUTION NO.2002-09
RESOLUTION ADJUSTING THE TOWN OF FOUNTAIN HILLS
"BASE LIMIT"PURSUANT TO ARTICLE IX,SECTION 20,
PARAGRAPH 6,CONSTITUTION OF ARIZONA;AND
DECLARING AN EMERGENCY.
WHEREAS,the Mayor and Council of the Town of Fountain Hills determine
that the Town's "Base Limit"for purposes of Arizona Constitution Article 9,Section 20 should
beincreasedby$1,000,000;and
WHEREAS,theConstitutionoftheStateofArizonarequiresthatanadjustment
tothe"BaseLimit"shallnotbecomeeffectiveuntilapprovedbyamajorityofthequalified
electors of the Town voting ata regularly scheduled election for members of the Town's
Governing Board;and
WHEREAS,itis necessary toapprovetheformofballotandauthorizethe
preparation of a publicity pamphlet and its submission tothe Auditor General of the State of
Arizona pursuant to A.R.S.41-563.03 andits dissemination tothe qualified electors ofthe Town
as provided bylaw.
NOW,THEREFORE,BE IT RESOLVED,bythe Mayor andCouncilofthe
Town of Fountain Hills,Arizona as follows:
Section 1.That the Town's "BaseLimit"forall purposes of Arizona
Constitution,Article 9,Section 20,shallbe adjusted from $3,302,273 to $4,302,273.Said
adjustment to become effective upon its approval bya majority of the qualified electors voting at
the Town's election tobe held on May 21,2002.The question shall be included onthe ballot in
substantially theformsetforthon Exhibit A attached hereto.
Section 2.Pursuant to Arizona Constitution Article 9,Section 20,Paragraph
6and A.R.S.§41-563.03,a publicity pamphlet shall be prepared and disseminated tothe
qualified electors ofthe Town inthe manner and within thetime provided bylaw.Such
publicity pamphlet shallbefirst submitted tothe Auditor General oftheStateofArizona
pursuant toA.R.S.§41-563.03 and revised insuch manner as may be required bythe Auditor
Generalpriorto dissemination tothe qualified electors.
Section 3.All officers,employees and legal counsel representing the Town
are hereby authorized totakeall actions anddoall things and enter intoall necessary or
advisable agreements toplacethe question ontheballotforthe May 21,2002electionandto
carryoutthe purposes and intents of this Resolution.
Section 4.All resolutions,or portions of resolutions,that conflict withthis
resolution are repealed.
Section 5.Due tothe urgent need to prepare the publicity pamphlet andfile
the same with the Auditor General nolessthan ninety-five (95)days prior to May 21,2002,an
emergency existsand therefore this Resolution shall become effective immediately.

Descriptive Title
Pursuant to the Arizona State Constitution,the Town of Fountain Hills,Arizona,seeks voter
approval to adjust the base limit of the Town as determined bythe Economic Estimates
Commission.TheTownseeksan adjustment of $1,000,000.
Proposition #400
ShallthebaselimitoftheTownof Fountain Hills,Arizona be permanently
adjusted byan increase of $1,000,000?
A "YES"vote shall have the effect of allowing the Town of Fountain Hills to increase its
expenditure limitto maintain existing and planned Town services including fire,emergency
medical,police,streets,parks and recreation,and capital improvements.Itwill allow the Town
touse taxes collected forfire services that were formerly collected bythefire district.
YES •
A"NO"vote shall have the effect of not allowing the Town of Fountain Hills to increase its
expenditure limit andmay result inthe Town not providing fireand emergency medical services.
