HomeMy WebLinkAboutRes 2002-10\ma^/ \^jt/ RESOLUTION NO.2002-10 RESOLUTION SUBMITTING TO THE QUALIFIED ELECTORS OF THE TOWN OF FOUNTAIN HILLS, ARIZONA,THE QUESTION OF AUTHORIZING THE TOWN TO LEVY PRIMARY PROPERTY TAXES AND DECLARING AN EMERGENCY. WHEREAS,theTownof Fountain Hills,Arizona (the"Town")hasneverlevied primary property taxes;and WHEREAS,theMayorandCouncilhasdeterminedthatitwillbe necessary to levyprimarypropertytaxescommencinginfiscalyear2002/2003andlaterfiscalyears,to defraytheTown'saddedcostsof providing fire protection and emergency medicalservices;and WHEREAS,A.R.S.§42-17056requiresthattheMayorandCouncilsubmitthe question authorizing thelevyof primary property taxestothe qualified electors oftheTownat anelectiontobeheldonthethirdMondayinMay,beforethe beginning ofthefiscalyearin which the primary property taxes are initially levied. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF FOUNTAIN HILLS,ARIZONA,as follows: Section 1.That at the election to be held in and for the Town of Fountain Hills,Arizona,on May 21,2002,the question set forth on Exhibit A shall be submitted tothe qualified electors of the Town. Section 2.TheClerkisherebydirectedtocausethepreparationand distribution of an information pamphlet and sample ballot.The officers of the Town arehereby authorized to prepare and deliver,or cause tobe prepared and delivered totheClerk,the information necessary or appropriate for completing such information pamphlet,including, without limitation,the estimated taxrate impact onan average owner/occupied residence and commercial and industrial property,an introductory statement on behalf of the Town anda statement for which the primary property taxes aretobe levied. Section 3.Notice of theactionandofthe questions tobe presented atthe election shallbegivenby causing the information pamphlet tobe mailed,inthe manner required bylaw,tothe residence of each registered voter of the Town,as shown onthe general county register.The Clerk is hereby authorized and directed to cause the information pamphlet tobe prepared and mailed as required bylaw. Section 4.By reason of the urgent need forthe preparation ofthe information pamphlet,the immediate operation ofthe provisions ofthis resolution is necessary forthe preservation ofthepublicpeace,healthandsafety,andan emergency ishereby declared toexist. Descriptive Title Pursuant to the Arizona Revised State Statutes,the Town of Fountain Hills,Arizona,seeks voter approvaltolevya primary property tax.The Town seeksaninitialamountof $2,400,000. Proposition #401 Shallthe Town of Fountain Hills,Arizona,be authorized tolevya primary propertytaxintheinitialamountof$2,400,000;iftheamountisapproveditwill bethebasefor determining levy limitations forthe Town for subsequent fiscal years. AYESvotewill have the effect of allowing the Town of Fountain Hillsto levy a primary property tax.This primary property tax would replace the secondary tax levied bythe former fire district. ANOvotewill have the effect of not allowing the Town of Fountain Hillstolevya primary property taxand may result intheTownnot providing fireand emergency medical services.
