RESOLUTION 2002-26
A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS,ARIZONA ABANDONING WHATEVER
RIGHT,TITLE,OR INTEREST IT HAS IN A PORTION OF THE CERTAIN
TEN (10')FOOT PUBLIC UTILITY AND DRAINAGE EASEMENTS ALONG
THE NORTHERLY LOT LINES OF LOTS 15,16,AND 17,AND THE
EASTERLY 10'EASEMENT OF LOT 16 AND THE WESTERLY 10'
EASEMENT OF LOT 15.THE SOUTHERLY 20'OF THE COMMON 10'
PUBLIC UTILITY EASEMENTS BETWEEN LOTS 15 AND 16 WILL BE
RETAINED.ALL EASEMENTS ARE LOCATED IN BLOCK 7,OF PLAT
204,FOUNTAIN HILLS,ARIZONA,AS RECORDED IN BOOK 142 OF
MAPS,PAGE 10,RECORDS OF MARICOPA COUNTY,ARIZONA.
WHEREAS,TheTown Council oftheTownof Fountain Hills,asthe governing body of real property
locatedintheTownofFountainHills,mayrequirethededicationofpublicstreets,sewer,
water,drainage,andotherutilityeasementsorrights-of-waywithinanyproposed
subdivision;and
WHEREAS,TheTownCounciloftheTownofFountainHillshastheauthoritytoacceptorrejectoffers
ofdedicationofprivatepropertybyeasement,deed,subdivision,platorotherlawful
means;and
WHEREAS,Allpresentutilitycompanieshavereceivednotificationoftheproposedabandonment;
NOW THEREFORE,beitresolvedbythe Mayor and Common Council of theTownofFountainHills,
Arizona as follows:
•SECTION 1 Thataportionofthecertainten(10)footpublicutilityanddrainageeasements,located
along the northerly property lotlines of Plat 204,Block 7,Lots15,16,and17andthe
easterlyand westerly ten(10)footpublicutilityand drainage easement ofLots16and15,
FountainHills,Arizona;asshownin Exhibit "A";as recorded inbook142ofmaps,page
10recordsof Maricopa County,Arizona;arehereby declared tobe abandoned bytheTown
ofFountainHills.Certainlotswithinthissubdivisionaresubjecttolot-to-lotdrainage
runoff.ThepropertyownersofLots15,16,and17arerequiredtopassthedeveloped
flowsgeneratedbytheupstreamlotsacrosstheirproperty.
SECTION 2.ThatthisResolutionisoneofabandonmentanddisclaimerbytheTownsolelyforthe
purposeof removing anypotentialcloudonthetitletosaid property andthattheTownin
nowayattemptstoaffecttherights of anyprivatepartyto oppose the abandonment or
assertanyright resulting therefrom or existing previous toany action bythe Town.
