WHEREAS,
RESOLUTION 2002-27
A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS,ARIZONA ABANDONING WHATEVER
RIGHT,TITLE,OR INTEREST IT HAS IN A PORTION OF THE CERTAIN
TEN (10')FOOT PUBLIC UTILITY AND DRAINAGE EASEMENTS ALONG
THE SOUTHERLY LOT LINE OF LOT 2,BLOCK 4,OF PLAT 506A,
FOUNTAIN HILLS,ARIZONA,AS RECORDED IN BOOK 159 OF MAPS,
PAGE 30,RECORDS OF MARICOPA COUNTY,ARIZONA.
TheTownCounciloftheTownofFountainHills,asthegoverningbodyofrealproperty
locatedintheTownofFountainHills,mayrequirethededicationofpublicstreets,sewer,
water,drainage,andotherutilityeasementsorrights-of-waywithinanyproposed
subdivision;and
WHEREAS,TheTownCounciloftheTownofFountainHillshastheauthoritytoacceptorrejectoffers
ofdedicationofprivatepropertybyeasement,deed,subdivision,platorotherlawful
means;and
WHEREAS,Allpresentutilitycompanieshavereceivednotificationoftheproposedabandonment;
NOW THEREFORE,beitresolvedbythe Mayor and Common Council of the Town of Fountain Hills,
Arizona as follows:
SECTION 1 Thataportionofthecertainten(10)footpublicutilityanddrainageeasements,located
alongthe southerly property lotlineofPlat506A,Block 4,Lot2,Fountain Flills,Arizona;
asshowninExhibit"A";asrecordedinbook159ofmaps,page30recordsofMaricopa
County,Arizona;are herebydeclared tobe abandoned bythe Town of Fountain Hills.
Certainlotswithinthissubdivisionaresubjecttolot-to-lotdrainagerunoff.Theproperty
ownersof Lot 2are required topassthe developed flows generated bythe upstream lots
across their property.
SECTION 2.ThatthisResolutionisoneofabandonmentanddisclaimerbytheTownsolelyforthe
purposeof removing anypotentialcloudonthetitletosaidpropertyandthatthe Town in
noway attempts to affect therights of any private partyto oppose the abandonment or
assert any right resulting therefrom or existing previous toany action bythe Town.
