RESOLUTION 2002-29
A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
TOWN OF FOUNTAIN HILLS,ARIZONA ABANDONING WHATEVER
RIGHT,TITLE,OR INTEREST IT HAS IN A PORTION OF THE
CERTAIN ONE (1')FOOT VEHICULAR NON-ACCESS EASEMENT
LOCATED WITHIN TRACT A OF SUNRIDGE CANYON PARCEL D-
NORTH,FOUNTAIN HILLS,ARIZONA,AS RECORDED IN BOOK 434
OF MAPS,PAGE 50,RECORDS OF MARICOPA COUNTY,ARIZONA;
AND LYING WITHIN THE 20'ACCESS EASEMENT AND THE SRP
ACCESS EASEMENT,BOTH LOCATED ADJACENT TO THE
WESTERLY CUL-DE-SAC BULB OF WILDCAT COURT.
WHEREAS,The Town Council of the Town of Fountain Hills,asthe governing body ofreal property
located inthe Town of Fountain Hills,may require the dedication of publicstreets,sewer,
water,drainage,and other utility easements or rights-of-way within any proposed
subdivision;and
WHEREAS,The Town Council of the Town of Fountain Hills hasthe authority to accept or reject
offers of dedication of private property by easement,deed,subdivision,plator other
lawful means;and
WHEREAS,Allpresentutility companies havereceived notification ofthe proposed abandonment;
NOW THEREFORE,beit resolved bythe Mayor and Common Council ofthe Town of Fountain Hills,
Arizona as follows:
SECTION 1.Thataportionofthecertainone(1)foot Non-Vehicular easement,locatedwithinTractA
of Sun Ridge Canyon Parcel D-North,Fountain Hills,Arizona;as shown in Exhibit "A";
asrecordedinbook434ofmaps,page50recordsof Maricopa County,Arizona;andlying
withinthe 20'access easement andthe SRP access easement,both located adjacent tothe
westerlycul-de-sacbulbofWildcatCourtisherebydeclaredtobeabandonedbytheTown
of Fountain Hills.
SECTION 2.That this Resolution is one of abandonment and disclaimer bythe Town solely forthe
puipose of removing anypotentialcloudonthetitletosaidpropertyandthattheTownin
nowayattemptstoaffecttherightsofanyprivatepartytoopposetheabandonmentor
assertanyrightresultingtherefromorexistingprevioustoanyactionbytheTown.
