HomeMy WebLinkAbout2015.1015.TCRM.Minutesz:\council packets\2015\r151119\151015m.docx Page 1 of 9 TOWN OF FOUNTAIN HILLS MINUTES OF THE REGULAR SESSION OF THE FOUNTAIN HILLS TOWN COUNCIL October 15, 2015 * CALL TO ORDER Mayor Kavanagh called the meeting to order at 6:30 p.m. in the Town Hall Council Chambers and said that the Pledge of Allegiance this evening will be led by Staff Sergeant Henry. * INVOCATION – Pastor Counselor Scott Erkelens, Church of Jesus Christ of Latter Day Saints * ROLL CALL Present for roll call were the following members of the Town Council: Mayor Linda Kavanagh, Vice Mayor Dennis Brown, Councilmember Nick DePorter, Councilmember Cecil Yates*, Councilmember Alan Magazine and Councilmember Henry Leger. Town Manager Grady Miller, Town Attorney Andrew McGuire and Town Clerk Bevelyn Bender were also present. Councilmember Cassie Hansen was absent from the meeting and Councilmember Yates* participated in the entire meeting through the use of telephonic equipment. * MAYOR’S REPORT (i) The Mayor will read a Proclamation declaring October 24, 2015 as Make a Difference Day in the Town of Fountain Hills. Mayor Kavanagh stated that serious social problems concern our Nation, State and Town and threaten our future and connecting with others and working together through volunteer service can bridge the differences that separate people and help solve serious social problems. She noted that the American people and residents of Fountain Hills have a tradition of philanthropy and volunteerism and almost four million people cared enough about their communities to volunteer on Make A Difference Day, accomplishing thousands of projects in hundreds of cities and towns. She pointed out that 2015 marks the 7th year for Fountain Hills to demonstrate that it is the small Town with a bi g heart, proclaimed October 24, 2015 as Make a Difference Day in Fountain Hills and urged all citizens to participate in volunteer projects as they work together to meet the needs of their neighbors. (ii) The Mayor will read a Proclamation declaring October 23 - 31, 2015 as National Red Ribbon Week in the Town of Fountain Hills. Mayor Kavanagh advised that alcohol and drug abuse in this nation have reach epidemic stages and it is imperative that viable, unified prevention education efforts by community members be launched to eliminate the demand for drugs. She said that the East Valley Young Marines , the local unit of the United States Young Marines, is a youth education and service program for boys and girls that focuses on promoting the mental, moral and physical development of its members, including character building, leadership and encouraging a healthy, drug -free lifestyle. She added that the Young Marines is the official youth program of the United States Marine Corps and is the focal point for the U.S. Marine Corps' Youth Drug Demand Reduction efforts and is open to youths, ages eight through high school completion who are in good standing in their school. She stated that the National Red Ribbon Campaign and the East Valley Young Marine program offers citizens the opportunity to demonstrate their commitment to drug -free lifestyles, (no illegal use of legal drugs) and the National Red Ribbon Campaign will be celebrated in every community in America during Red Ribbon Week, October 23 - 31, 2015. She further stated that businesses, government, parents, law enforcement, media, medical institutions, religious instit utions, schools, senior citizens, service organizations and youths will demonstrate their commitment to healthy, drug-free lifestyles by wearing and displaying red ribbons during this week-long campaign. She emphasized that the Town further commits its re sources to ensure the success of the Campaign and proclaimed October 23 - 31, 2015 as Red Ribbon Week and encouraged the Town's citizens to participate in drug prevention education activities, not only during Red Ribbon Week but all year long, making a visible statement that the Town is strongly committed to a drug-free Fountain Hills. z:\council packets\2015\r151119\151015m.docx Page 2 of 9 (iii) The Mayor will read a Proclamation declaring October 18 - 24, 2015 as Arizona Cities & Towns Week in the Town of Fountain Hills. Mayor Kavanagh advised that the citizens of Fountain Hills rely on the Town to experience a high quality of life in their community and cities and towns in Arizona work 24 hours a day, seven days a week to deliver vital city and town services such as fire, police and emergency medical respons e to ensure safe communities. She noted that cities and towns in Arizona also provide services and programs that enhance the quality of life for residents such as parks, utilities, street maintenance, sanitation and recycling services, libraries, community centers and recreational programs and it is important for the Town to continue to provide the excellent delivery of services and programs that the citizens have come to expect in the community. She pointed out that it is one of the responsibilities of To wn officials to ensure open and accessible government through frequent communication with citizens using various avenues and means and through participation and cooperation, citizens, community leaders, local businesses and municipal staff can work together to ensure that services provided by the Town can remain exceptional elements of the quality of life in the community. The Mayor proclaimed that the Town of Fountain Hills joins with the League of Arizona Cities and Towns and fellow municipalities across the State of Arizona in declaring October 18 - 14, 2015, Arizona Cities & Town's Week. * SCHEDULED PUBLIC APPEARANCES/PRESENTATIONS (i) Mayor Kavanagh may review recent events attended relating to economic development. The Mayor had no remarks to present at this time. (ii) Recognition of Retiring Planning and Zoning Commissioners Lloyd E. Pew and Denise Ham. The Mayor advised that neither of the Commissioners are present this evening and noted that the Commission is a voluntary group and its members are very dedicated and put in a lot of their time. She said that Mr. Pew, the outgoing Chairman, served on the Commission from 2007 until September 2015 and served as Chairman for the last four years. She noted that he has been a very valuable member of the Commission and the Council appreciates his time and dedication to various issues brought before the Commission that required thoughtful decision making. She thanked him for all of his contributions to the Town of Fountain Hills. The Mayor further stated that Denise Ham served on the Commission from February 2015 until September 2015 and served with pride for the residents of the community. She thanked Ms. Ham for her service to the Town. (iii) Recognition of the Gold Status Award for "Best Ad Series" presented to the Town of Fountain Hills at the International Festival and Events Association Conference held in Tucson, Arizona. Town Manager Grady Miller advised that the Town recently learned that it is the recipient of two separate awards from the International Festival and Events Association and stated that it speaks very highly of the staff that they have. He pointed out that they have only been in the tourism business for a little over a year and a half so it speaks volumes about the capabilities of the staff and what they have been able to do to date. He called upon Recreation Supervisor Rachael Goodwin and Tourism Coordinator Grace Rodman to address the Council. Ms. Rodman noted that she and Ms. Goodwin had the opportunity to attend the International Festival and Events Association Conference held in Tucson. She added that they are honored to be the recipients of two awards from the Association. Ms. Goodwin briefly highlighted the two awards for the Council and explained the way the awards are structured, on a budget, and the Town's budget is under the $250,000 mark and they were awarded the Gold Award for the Best Ad Series. She referred to a slide showing what they had submitted (Copy of which are available on line and in the office of the Town Clerk). She added that Grace is also a scholarship winner to that conference, which was given in recognition of her ambition. Grace said that she is very honored and thankful to be recognized for their marketing skills on an international level. Councilmember Magazine added his congratulations for the great work they are doing. (iv) Recognition of the Bronze Status Award for "Best Company Image Piece" for the Tourism Program logo presented to the Town of Fountain Hills at the International Festival and Events Association Conference held in Tucson, Arizona. z:\council packets\2015\r151119\151015m.docx Page 3 of 9 Grace Rodman-Guetter addressed the Council and briefly discussed the second award, a Bronze Status Award for the Tourism Logo. Ms. Rodman-Guetter and Ms. Goodwin were given a round of applause and pictures were taken with the Mayor. CALL TO THE PUBLIC None. CONSENT AGENDA AGENDA ITEM #1 - CONSIDERATION OF APPROVING THE TOWN COUNCIL MEETING MINUTES FROM OCTOBER 1, 2015. AGENDA ITEM #2 - CONSIDERATION OF APPROVING A LIQUOR LICENSE TEMPORARY EXTENSION OF PREMISES/PATIO PERMIT - PARKING LOT TAILGATE PARTY AS SUBMITTED BY DARVEL KENT HANSEN, OWNER/AGENT OF THE CLUB, LOCATED AT 17005 ENTERPRISE DRIVE, FOUNTAIN HILLS, ARIZONA. PAUL NORDIN PARKWAY AND AT 16845 E. AVENUE OF THE FOUNTAINS (PLAT 208, BLOCK 7, LOTS 1,2,3 & 5). CASE #S2015-08. THIS ITEM WAS TABLED FROM THE 10/1/15 COUNCIL MEETING. Town Manager Grady Miller addressed the Council and stated that this item was on the agenda of the October 1st meeting and reported that the applicants are getting closer to having the re-plat documents completed but they were not here in time to be able to be placed on this evening's agenda. He pointed out that there are several moving parts to it and staff is trying to work with the applicant on getting these issues worked out. He requested that the Council table this agenda item to a future date. Mayor Kavanagh thanked Mr. Miller for all of the work he has done on this and said he has been doing a tremendous job. Councilmember Magazine MOVED to table this agenda item to a future meeting and Vice Mayor Brown SECONDED the motion, which CARRIED UNANIMOUSLY by those present (6-0). AGENDA ITEM #8 - CONSIDERATION OF A JOINT PROJECT BETWEEN THE TOWN, THE FOUR PEAKS ROTARY CLUB, THE GREENING OF DOWNTOWN GROUP AND THE CULTURAL AND CIVIC ASSOCIATION FOR THE CREATION OF A HARMONY MUSICAL PLAYGROUND AT FOUNTAIN PARK. Community Services Director Mark Mayer addressed the Council relative to this agen da item and advised that a number of months ago, he was approached by the Four Peaks Rotary Club, represented by Mr. Steve Ryan, Jerry Butler who is with the Greening Committee and Jenny Willigrod to talk about a particular project and pursue finding out whether there was interest in pursuing the project on the part of the Town and perhaps working on a partnership (for the creation of a Harmony Musical Playground at Fountain Park). He said that they held a number of meetings and it culminated in the proposal going in front of the Community Services Advisory Commission at their most recent meeting. He reported that the Commission voted overwhelmingly at that meeting to recommend to the Council positive consideration of this request. He stated that Mr. Ryan, Mr. Butler and Ms. Willigrod are present this evening to respond to any questions the Council might have and Mr. Ryan is prepared to make a presentation on what is being proposed. Mr. Ryan addressed the Council and stated that every now and then a project comes along that is both meaningful as well as fun and exciting. He indicated his intention to share with everyone a new and exciting project for Fountain Park and highlighted a brief presentation (Copy available on line and in the office of the Town Clerk). * Harmony Musical Playground - A cooperative effort between the Town of Fountain Hills, Four Peaks Rotary Club, the Greening of Downtown Group and the Cultural and Civic Association * Location - Center of Fountain Park Playground * The Musical Playground and many different instrument options available * The Benefits * Endorsement * Freenotes Harmony Park * The Plan * The Costs Musical Playground Equipment $44,000 (12 instruments) Installation $7,200 Landscaping $17,200 * Possible Objections * Creating a new Fountain Park attraction Mr. Ryan noted that funds would be provided by the Four Peaks Rotary Club and it is anticipated that it would take several years for the Club to raise this amount. He added that the Greening of Downtown is proposing to pl ace eighteen trees in the border area surrounding the musical pieces (see landscaping costs above). z:\council packets\2015\r151119\151015m.docx Page 5 of 9 Mayor Kavanagh thanked Mr. Ryan for his presentation and stated that this would be an awesome addition to the Park and she hopes they will be applying for the Republic Services $10,000 grant which will be coming up next year. Councilmember DePorter stated that he couldn't be more excited about it, especially coming from the groups that have already contributed so much to the Town. He added that maintenance and up keep will have to be addressed but this will be a huge addition to the Town. In response to a question from Vice Mayor Brown, Mr. Mayer clarified the actual proposed location of the Musical Playground. The Vice Mayor stated that it would be a great addition to the Park. Councilmember Magazine advised that he too is very excited about this and both organizations are to be commended. He asked whether the organizations have considered the possibility of any benches for parents, grandparents, etc., who want to sit while the younger children play the instruments. Mr. Butler addressed the Council and discussed the things that the Greening Committee will be doing and added that there will be places in this zone for future benches but they have not proposed any at this time. He pointed out that in the past the Town has had requests from residents to donate benches to the community and there are no more spaces available in Fountain Park so this project might provide some new spaces in a beautiful setting. In response to a question from the Mayor, Mr. Mayer confirmed that they have actually filled all the spots available in Fountain Park for benches and also the spots in Centennial Circle as well. He noted that they literally have a waiting list. Councilmember Leger MOVED to approve the joint project between the Town of Fountain Hills, the Four Peaks Rotary Club, the Greening of Downtown group and the Cultural and Civic Association for the creation of a Harmony Musical Playground in Fountain Park and Vice Mayor Brown SECONDED the motion, which CARRIED UNANIMOUSLY by those present (6-0). AGENDA ITEM #9 - CONSIDERATION WITH POSSIBLE DIRECTION TO STAFF REGARDING (I) THE APPROVAL OF TWO NEW SISTER CITY SIGNS, (II) THE SIGN LOCATIONS ON SHEA BOULEVARD, AND (III) THE WAIVER OF REQUIRED PERMIT FEES, NOT TO EXCEED $1,000. Town Manager Grady Miller addressed the Council relative to this agenda item and advised that the item before them is a request from the Fountain Hills Sister Cities Corporation for consi deration of two new Sister Cities signs. He explained that several months back, the Sister Cities Corporation approached the Town about the possibility of switching the sign that they currently have on Fountain Hills Boulevard and going with more attractive signage as people come into Town on both the eastern and western ends of Town. He advised that he is very pleased to say that both staff and the Sister Cities Corporation have been able to work cooperatively on some very attractive signs (Copy available on line and in the office of the Town Clerk) that are in the median on Shea Boulevard. He reported that former Councilmember/Boardmember Ed Kehe did an excellent job working with the vendor in trying to meet the Town's requirements and also come up with attractive signs that will give a very positive impression to people visiting the Town. Mr. Miller further stated that in addition to requesting the Council's approval of the signs and their location, they are also being asked to consider the waiver of the permit fees which amounts to approximately $980 so the Council is being asked to waive the required permit fees not to exceed $1,000. (The signs and installation will be paid for by the Fountain Hills Sister Cities Corporation and thereafter the Town will be responsible for the maintenance and upkeep of the signs. The old signs will come down when the new signs are installed.). He indicated his willingness to respond to any questions from the Council and added that Councilmember/Boardmember Ed Kehe is also present to respond to questions. Mr. Miller displayed PowerPoint photos of the proposed signs. Town Clerk Bevelyn Bender stated that there were no citizens wishing to speak on this item. Councilmember Leger applauded the group for their efforts and said that their request makes good sense and the signs will be highly visible. z:\council packets\2015\r151119\151015m.docx Page 6 of 9 Mr. Ed Kehe informed the Council that this has been on the group's bucket list for a long time and discussed the good working relationship they have with staff. He thanked the Town Council and staff for their support. Mayor Kavanagh thanked Mr. Kehe for all the work he has done on this project. Mr. Kehe also announced that a major contribution to this project is being made by Echelon Builders owned by Vice Mayor Brown who are going to install the signs and that is a major job and very costly and the project might have been difficult to accomplish without that. He thanked the Council very much on behalf of the Sister Cities Corporation. Councilmember Leger MOVED to approve the two new Sister Cities Corporation signs and their locations on Shea Boulevard and to waive the permit fees up to $1,000 as requested and Vice Mayor Brown SECONDED the motion. There were no citizens wishing to speak on this agenda item. The motion CARRIED UNANIMOUSLY by those present (6-0). AGENDA ITEM #10 - DISCUSSION WITH POSSIBLE DIRECTION TO STAFF REGARDING A PROPOSED TOWN OF FOUNTAIN HILLS ZONING ORDINANCE AMENDMENT ADDRESSING LIGHTING STANDARDS AND REGULATIONS. Town Manager Grady Miller addressed the Council relative to this agenda item and advised that the item before the Council relates to a request by a citizens' committee that was formed to have the Town consider changing and updating its current ordinances relating to lighting standards and regulations. He reported that the Fountain Hills Dark Sky Committee under the leadership of a number of people including Nancy Bill and Joe Bill as well as other esteemed people such as former Mayors Jay Schlum and Jerry Miles were very ac tive in working on this process. He stated that before them is a request to direct staff to come back at a later date with an updated ordinance that will include staff recommendations as they relate to this. He pointed out that staff has had an opportunity to review this and provide feedback back to the Committee but there are other areas that require further study before they bring it back to the Council. He added that his understanding is that there are some areas that might need to go before Planning & Zoning prior to being brought back before the Council so he is requesting formal direction to staff to come back at a later time with an ordinance and staff recommendations on this item. He informed the Council that Mr. & Mrs. Bill were planning on attending the meeting this evening but they are out of Town. He added that there are other members of the Committee present should the Council have any questions at this time. Mayor Kavanagh asked if this is to be the official designation of Dark Skies or are they just going to look at some changes to the ordinance. Mr. Miller replied that the Committee actually approached the Town initially about doing two things -- one was to address and update the Town's ordinances as they relate to lighting and lighting standards as well as enforcement and they also requested consideration relative to having the Town become a Dark Skies community, which is a membership in an organization that has its own series of requirements for that. He further stated that tonight sta ff is asking the Council strictly to consider directing staff to come back at a later date just to address the ordinance portion. He added that he believes in the future they will either have a Work Study Session or extensive discussion at a future Council meeting regarding the possibility of the Town becoming a Dark Skies community and joining that organization. Mayor Kavanagh commented that they met with Nancy and Joe Bill and they had some concerns but it is nice to see in the packet that they have answered all of those concerns (the business community, the lights around the Fountain, etc.). She also thanked them for meeting with them in person. Councilmember Leger noted that all of them have had an opportunity to meet with Nancy and Joe and they have done a tremendous job as did the other members of the Committee. He added that in the Council's packets there was a very extensive proposal that walks them as the Council through the process. He clarified that tonight they are simply taking their existing lighting ordinance and updating it with recommendations and compromises made in concert working with Nancy and Joe Bill and others involved on the Committee. z:\council packets\2015\r151119\151015m.docx Page 7 of 9 Mr. Miller agreed with Councilmember Leger's comments. Councilmember Yates advised that he had a fantastic meeting with those folks and reminded the Council and the residents that this is a Strategic Direction -- to take every opportunity to minimize noise, air and light pollution and reduce energy consumption. He stated that he thinks that there is a way that they can mix the Dark Sky ordinance in with a vibrant Downtown. Councilmember Magazine added his thanks for the effort expended in putting all of this together -- a lot of work by a lot of people. Councilmember Magazine MOVED to direct the Town Manager to bring back to the Council an amended ordinance with staff recommendations at a future Town Council meeting and Councilmember DePorter SECONDED the motion. There were no citizens wishing to speak on this agenda item. The motion CARRIED UNANIMOUSLY by those present (6-0). AGENDA ITEM #11 - DISCUSSION WITH POSSIBLE DIRECTION TO STAFF RELATING TO ANY ITEM INCLUDED IN THE LEAGUE OF ARIZONA CITIES AND TOWNS WEEKLY LEGISLATIVE BULLETIN OR RELATING TO ANY ACTION PROPOSED OR PENDING BEFORE THE STATE LEGISLATURE. Mayor Kavanagh advised that this item was placed on the agenda at her request because the Town has received some communication, emails and phone calls from residents who have quite a few Group Homes on their street and they were very concerned about this and want the Town to do something about it -- pass some ordinances and put some restrictions on this. She stated that unfortunately they had to explain to the residents that this type of Group Home falls under the Federal Fair Housing Act and the Town does not have any type of control right now. She added that at the Resolutions Committee meeting at the League they did pass a resolution proposing the expansion of State licensure requirements and local enforcement authority for the Sober Living Group Homes. She explained that they are asking the State to give them a bill that will grant the Town more control, as limited as it will be as far as the Federal Government will allow, but some sort of control perhaps on how many can be put in a certain neighborhood or on a certain block. She added that they will see what they can draft together with the Legislature to give some of these streets some relief. She pointed out that there are parking issues, lots of noise, people coming and going a nd if you have one on your street that is one thing but if you end up with three on your street it becomes a problem for the rest of the neighborhood. She stated that she is hoping that through the Legislature they will be able to get some changes put into place to give the Town some authority to place some sort of restrictions on these homes in the Town. She reported that this was originally submitted by Prescott because they have a much bigger problem than Fountain Hills but it was 100% supported by the League. Councilmember Magazine asked whether the Town has experienced problems and received complaints or is this to protect the Town for the future. Mayor Kavanagh replied yes and that one particular street in Town has three Group Homes and it appears that that is causing a problem for the neighborhood. She reiterated that basically the Town has no control at all over that because it is under the Federal Fair Housing Act. Councilmember Magazine asked whether anyone can declare a home to be a Group Home and Mayor Kavanagh responded yes and no Special Use Permits are required. She added that as far as she knows they don't even have to come to the Town so they don't even know about their existence until after the fact. Councilmember Magazine commented that in his experience that is very unusual -- municipalities that he is familiar with usually require a Special Use Permit and the applicants have to answer a lot of questions about location, size, square footage, etc. z:\council packets\2015\r151119\151015m.docx Page 8 of 9 The Mayor advised that they are going to try and get some of those restrictions in place and said that perhaps what Councilmember Magazine is referring to was in place before they were part of the Fair Housing Act. Councilmember Leger stated that in some areas of Town there might be homes for women who have experienced domestic violence and keeping that private rather than for public consumption and approval by the Town Council is usually there by design. He added that he would hope that the Legislature is sensitive in terms of the categories of these types of Group Homes. Mayor Kavanagh informed Councilmember Leger that this is dealing with Sober Living Group Homes (alcohol rehabilitation). AGENDA ITEM #12 - COUNCIL DISCUSSION/DIRECTION TO THE TOWN MANAGER. Items listed below are related only to the propriety of (i) placing such items on a future agenda for action or (ii) directing staff to conduct further research and report back to the Council. A. None. AGENDA ITEM #13 – SUMMARY OF COUNCIL REQUESTS AND REPORT ON RECENT ACTIVITIES BY THE MAYOR, INDIVIDUAL COUNCILMEMBERS AND THE TOWN MANAGER. Councilmember DePorter advised that he, Mayor Kavanagh and Town Manager Miller attended the Fountain Hills Fire Department graduation a couple of weeks ago and said it was fantastic to meet the 12 new graduates. He noted that they are all cross trained now and that provides much greater service to the residents. He further stated that the three of them also attended Groupon's grand opening at ASU Sky Song and noted that they were heavily involved at Arizona State University in landing Groupon and getting them to open up one of their west coast offices here in the Valley. He reported that they have 150 staff and are looking to go up to 500. He said that he volunteered his time to the League of Cities Resolution Policy Committee for budget, finance and economic development and as items come up he will get called to be a part of that and the Town will have representation on that which is very exciting. He stated that he is very excited to represent the Town on those fronts. Mayor Kavanagh noted that it is a perfect fit because Councilmember DePorter works with economic development with ASU and has so many business connections and has been involved in the committees so he is just the perfect choice to take on especially economic development. She thanked him for his involvement and said she knows he will do a great job.
