Kavanagh AGENDA ITEM #1 - ROLL CALL AND VOTE TO GO INTO EXECUTIVE SESSION: Mayor Kavanagh called the meeting to order. Present for roll call were the following members of the Town Council: Mayor Linda Kavanagh, Vice Mayor Dennis Brown, Councilmember Nick DePorter, Councilmember Cecil Yates, Councilmember Alan Magazine and Councilmember Henry Leger. Town Manager Grady Miller, Town Attorney Andrew M cGuire, Town Clerk Bevelyn J. Bender, Development Services Manager Paul Mood and Senior Planner Bob Rodgers were also present. Councilmember Cassie Hansen was absent. PURSUANT TO: (i) A.R.S. §38-431.03(A)(3), DISCUSSION OR CONSULTATION FOR LEGAL ADVICE WITH THE ATTORNEY OR ATTORNEYS OF THE PUBLIC BODY, AND (ii) A.R.S. §38- 431.03(A)(4), DISCUSSION OR CONSULTATION WITH THE ATTORNEYS OF THE PUBLIC BODY IN ORDER TO CONSIDER ITS POSITION AND INSTRUCT ITS ATTORNEYS REGARDING THE PUBLIC BODY’S POSITION REGARDING CONTRACTS THAT ARE THE SUBJECT OF NEGOTIATIONS, IN PENDING OR CONTEMPLATED LITIGATION OR IN SETTLEMENT DISCUSSIONS CONDUCTED IN ORDER TO AVOID OR RESOLVE LITIGATION (SPECIFICALLY: (i) A SETTLEMENT AGREEMENT ON A TAX ENFORCEMENT ACTION, AND (ii) THE PARK PLACE DEVELOPMENT AGREEMENT). Councilmember DePorter MOVED to go into Executive Session at 5:15 p.m. and Councilmember Yates SECONDED the motion, which CARRIED UNANIMOUSLY (6-0). Development Services Director Paul Mood and Senior Planner Robert Rogers entered the meeting at 5:17 PM. AGENDA ITEM #2 - ADJOURNMENT. The Executive Session adjourned without objection at 6:19 p.m. REGULAR SESSION AGENDA  CALL TO ORDER AND PLEDGE OF ALLEGIANCE Mayor Kavanagh called the meeting to order at 6:30 p.m.  INVOCATION – Senior Pastor Justin Erickson, Harvest Bible Chapel Fountain Hills  ROLL CALL Present for roll call were the following members of the Town Council: Mayor Linda Kavanagh, Vice Mayor Dennis Brown, Councilmember Nick DePorter, Councilmember Cecil Yates, Councilmember Alan Magazine and Councilmember Henry Leger. Councilmember Cassie Hansen was absent. z:\council packets\2015\r151217\151203m.docx Page 2 of 4  MAYOR’S REPORT i) ROTATION OF THE VICE MAYOR position to Councilmember Henry Leger; Pursuant to Section 2-2-2 of the Fountain Hills Town Code that each member of the Council, except the Mayor, shall serve a term of approximately eight months as Vice Mayor and shall perform the duties of the Mayor during his absence or disability. Mayor Kavanagh expressed her appreciation to Councilmember Brown for his assistance during his term as Vice Mayor. ii) The Mayor will read a PROCLAMATION recognizing L. Alan Cruikshank River of Time Museum. Mayor Kavanagh read a proclamation outlining the reasons why the L. Alan Cruikshank River of Time Museum was a valuable asset and congratulated the museum on its recent renovations.  SCHEDULED PUBLIC APPEARANCES/PRESENTATIONS i) Mayor Kavanagh may review RECENT EVENTS attended relating to Economic Development. CALL TO THE PUBLIC None. CONSENT AGENDA AGENDA ITEM #1 - CONSIDERATION OF APPROVING THE TOWN COUNCIL MEETING MINUTES FROM NOVEMBER 10, 2015. AGENDA ITEM #2 - CONSIDERATION OF APPROVING A FAIR/FESTIVAL LIQUOR LICENSE APPLICATION FOR DESERT DIAMOND DISTILLERY (JOHN PATT) TO BE LOCATED ALONG THE AVENUE OF THE FOUNTAINS, IN CONJUNCTION WITH THE FOUNTAIN HILLS WINE AND SCULPTURE EXPERIENCE, FROM 10:00 AM TO 5:00 PM DAILY, FROM FRIDAY, JANUARY 15 THROUGH SUNDAY, JANUARY 17, 2016. AGENDA ITEMS #3 - CONSIDERATION OF APPROVING A FAIR/FESTIVAL LIQUOR LICENSE APPLICATION FOR OAK CREEK VINEYARDS AND WINERY (DUBRAUKA WAHL) TO BE LOCATED ALONG THE AVENUE OF THE FOUNTAINS, IN CONJUNCTION WITH THE FOUNTAIN HILLS WINE AND SCULPTURE EXPERIENCE, FROM 10:00 AM TO 5:00 PM DAILY, FROM FRIDAY, JANUARY 15, THROUGH SUNDAY, JANUARY 17, 2016. Councilmember Magazine MOVED to approve the Consent Agenda as listed and Councilmember Brown SECONDED the motion. Item(s) listed below are related only to the propriety of (i) placing such item(s) on a future agenda for action or (ii) directing staff to conduct further research and report back to the Council: i.) None. AGENDA ITEM #5 - SUMMARY OF COUNCIL REQUESTS AND REPORT ON RECENT ACTIVITIES BY THE MAYOR, INDIVIDUAL COUNCILMEMBERS, AND THE TOWN MANAGER. Councilmember Yates requested a final report on the Saguaro Boulevard reconstruction project and Town Manager Miller indicated that staff was working on the punch list and he sure that the project was 99.8% completed and close to wrapping up. He stated that staff would bring forward a full report when it was ready to close out. The Mayor shared that she and Senator Kavanagh attended the Eagle Scout Ceremony for Fountain Hills’ youths: Kevin Perreault, Gabriel Anderson and Benjamin Troller. She stated that “We all know the dedication that goes into attaining the rank of Eagle Scout so I want to congratulate these three young men on their a chievement. The Town is also grateful to the scouts for choosing projects that have enhanced our town.” The Mayor thanked the Town’s Community Services team, especially Anjelica Giardino and Rachael Goodwin, for the incredible job organizing our Turkey Trot this year. It was exciting for me to start the race with 1,941 participants. Mayor Kavanagh stated that she had her first contact with many of the legislators last night at an informal gathering where they discussed some upcoming bills that have already been proposed. She thanked Senior Planner Bob Rodgers and Chief Building Official Jason Field for their input into two of the bills in particular, which she stated would not have been good for the Town. She said their information was of great help dur ing that discussion. She invited the public to visit the Community Center on Saturday starting at 2pm. She stated they could come make an ornament for our town community tree, see the trains in motion, enjoy musical entertainment and refreshments and at 5pm walk they would be able to walk the Avenue for the Chamber sponsored traditional Stroll in the Glow. She noted that many of the stores will be open. She stated that the she and the Chamber CEO would be present to hit the switch to light up the Avenue, and that Santa would be arriving on the fire truck to hear what all the kids want for Christmas. The Mayor also requested that the public keep the Food Bank in mind over the next few weeks and provided a reminder that some of the businesses have Angel Trees set up noting that Fountain Hills has a reputation for being a most giving Town and she expressed her appreciation for the public’s caring hearts this holiday season. AGENDA ITEM #6 - ADJOURNMENT. Councilmember Yates MOVED to adjourn the meeting and Councilmember Brown SECONDED the motion, which CARRIED UNANIMOUSLY (7-0).
