TOWN OF FOUNTAIN HILLS
MINUTES OF THE SPECIAL SESSION OF THE
FOUNTAIN HILLS TOWN COUNCIL
FEBRUARY 22, 2016
* CALL TO ORDER AND ROLL CALL
Mayor Kavanagh called the Special Session to order at 5:19 p.m. in the Town Hall Council Chambers.
Present for roll call were the following members of the Town Council: Mayor Linda Kavanagh, Vice Mayor Henry
Leger, Councilmember Dennis Brown, Councilmember Cecil Yates, and Councilmember Cassie Hansen.
Councilmember DePorter arrived at 5:20 PM; Councilmember Alan Magazine was absent.
Town Manager Grady E. Miller and Town Clerk Bevelyn Bender were also present. Town Attorney Andrew McGuire
participated via a teleconference call.
AGENDA ITEM #1 – CONSIDERATION OF APPROVING A SETTLEMENT OFFER RELATING TO A
TAX ENFORCEMENT ACTION.
Town Manager Grady Miller provided recap of this matter stating this had been on the agenda a couple of times and
finally the item had been removed with the Council taking action to rescind their prior action due to the party not
living up to what they had agreed to. He stated the action before the Council this evening was to approve a settlement
offer, in the amount $140,000, for taxes owed to the Town. He explained that the party involved had met in person
with the Town Attorney on Friday. The Town Attorney had contacted the finance company and determined that the
party was serious and verified that the funding would be in place to settle this matter. Mr. Miller stated that it was his
understanding that this needed to be settled by the end of the month and noted that it was staff’s recommendation to
approve.
There were no citizens wishing to speak on this agenda item.
Councilmember Yates MOVED to accept the settlement offer as presented. Councilmember Brown SECONDED the
motion, which CARRIED UNANIMOUSLY by those members present (6-0).
AGENDA ITEM #2 - ADJOURNMENT.
Councilmember Brown MOVED to adjourn the Special Session at 5:21 p.m. and Vice Mayor Leger SECONDED the
motion, which carried unanimously by those members present (6-0)
