ORDINANCE NO. 90-6
AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL
OF THE TOWN OF FOUNTAIN HILLS, ARIZONA,
APPOINTING THE MAYOR AND COUNCIL AS THE
INITIAL PLANNING AGENCY AND PLANNING AND
ZONING COMMISSION AND DECLARING AN EMERGENCY.
WHEREAS, A.R.S. § 9-461.3. 9-461.02 and 9-462.A.3.
provide for the creation of a planning agency and a planning and
zoning commission; and
WHEREAS, it is necessary for the town of Fountain Hills
to adopt a zoning ordinance and zoning map and make preparations
for a general plan; and
WHEREAS, these tasks should be accomplished prior to
July 1, 1990, the beginning of the new municipal fiscal year;
® NOW, THEREFORE, BE IT ORDAINED by the Mayor and Common
Council of the Town of Fountain Hills, Arizona, as follows:
Section 1. That pursuant to A.R.S. § 9-461.3. and
9-461.02 and 9-462.A.3. the Mayor and Council of the Town of
Fountain Hills is hereby designated as the Planning and Zoning
Commission of the Town of Fountain Hills.
Section 2. That the Mayor and Council shall perform
all of the duties required by law of the Planning and Zoning
Commission until such times as the Mayor and Council appoint a
new Planning and Zoning Commission.
Section 3. Whereas the immediate operation of the
provisions of this ordinance is necessary for the preservation of
the public peace, health, and safety of the citizens of the Town
of Fountain Hills, Arizona, in that a zoning ordinance and zoning
map must be in place prior to July 1, 1990; an emergency is
hereby declared to exist and this ordinance shall be in force and
effect from and after its passage, adoption by a three -fourths
majority of, and approval by the Town Council of the Town of
Fountain Hills, Arizona.
