AN ORDINANCE OF THE TOWN OF FOUNTAIN HILLS, ARIZONA, ADOPTING "THE CODE OF THE
TOWN OF FOUNTAIN HILLS, ARIZONA" BY REFERENCE, PROVIDING PENALTIES FOR THE
VIOLATION THEREOF, AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN HILLS,
ARIZONA:
Section 1: That certain document, known as "The Code of The Town of Fountain
Hills, Arizona", three copies of which are on file in the office
of the Town Clerk of The Town of Fountain Hills, Arizona, which
document was made a public record by Resolution No. 1990-17 of the
Town of Fountain Hills, Arizona, is hereby referred to, adopted and
made a part hereof as if fully set out in this ordinance.
Section 2: Any person found guilty of violating any provision of this code,
except as provided in Section 3 of this ordinance, shall be guilty
of a Class one misdemeanor. Each day that a violation continues
shall be a separate offense punishable as herein above described.
Section 3: Any violation of or failure or refusal to do or perform any act
required by Chapter 12 of this code constitutes a civil traffic
violation. Civil traffic violations are subject to the provisions
of Title 28, Chapter 6, Articles 20 and 21, Arizona Revised Statutes
and amendments thereof.
Section 4: All ordinances and parts of ordinances, in conflict with the
provisions of this ordinance or any part of the code adopted herein
by reference, are hereby repealed.
Section 5: If any section, subsection, sentence, clause, phrase or portion of
this ordinance or any part of the code adopted herein by reference
is for any reason held to be invalid or unconstitutional by the
decision of any court of competent jurisdiction, such decision shall
not affect the validity of the remaining portions thereof.
Section 6: Whereas, it is necessary for the preservation of the peace, health
and safety of The Town of Fountain Hills, Arizona, an emergency is
declared to exist, and this ordinance shall become immediately
operative and in force from and after the date of posting hereof.
PASSED AND ADOPTED by the Mayor and Common Council of The To of Fountain Hills,
Arizona, this 28th day of June, 1990.
