AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN
OF FOUNTAIN HILLS, ARIZONA, AMENDING THE TOWN CODE
CHAPTER 7, ARTICLE 7-1, SECTION 7-1-1 BY SPECIFYING
EXCEPTIONS TO THE UNIFORM BUILDING CODE, 1985 EDITION.
BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF
FOUNTAIN HILLS, ARIZONA AS FOLLOWS:
SECTION 1. Chapter 7, Article 7-1, Section 7-1-1 of the
Fountain Hills Town Code to be amended to read as follows:
a) Section 7-1-1 Adoption by Reference; Violations
A. The following listed publications, three copies of
which are on file in the office of the town clerk,
are hereby adopted by reference as if set out at
length in this code:
1. The Uniform Building Code, 1985 Edition.
Except the following:
Chapter 3, Section 301. (b) Exempted Work. A
building permit shall not be required for the
following:
2. Fences not over 6-feet 30 inches high.
5. Retaining walls which are not over 4-feet
2 feet in height measured from the bottom
of the footing to the top of the wall,
unless supporting a surcharge or
impounding flammable liquids.

3. The Uniform Mechanical Code, 1985 Edition.
The National Electrical Code, 1987 Edition.
5. The Uniform Fire Code and Uniform Fire Code
Standards, 1982 Editions including Appendix
Chapters I -A, I-B, II -A, II-B, II-C, II-D,
III -A, III-B, III-C and IV_A of the Uniform
Fire Code.

Sec. 301. (a) Permits Required. Except as specified in Subsection (b) of this
section, no building or structure regulated by this code shall be erected, con-

structed, enlarged, altered, repaired, moved, improved, removed, converted or
demolished unless a separate permit for each building or structure has lust been

obtained from the building official.
(b), Exempted building permit shall not be required for the following:

I. One-story detached accessory buildings used as tool and storage sheds,
playhouses and similar uses, provided the projected roof area does not
exceed 120 square feet.

Unless otherwise exempted, separate plumbing, electrical and mechanical
permits will be required for the above exempted items.
Exemption from the permit requirements of this code shall not be deemed to
grant authorization for any work to be done in any manner in violation of the

provisions of this code or any other laws or ordinances of this jurisdiction.
Application for Permit
Sec. 302. (a) Application. To obtain a permit, the applicant shall first file an

application therefor in writing on a form furnished by the code enforcement

agency for that purpose. Every such application shall:
I. Identify and describe the work to be covered by the permit for which

application is made.
