ORDINANCE NO. 91-11
AN ORDINANCE OF THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN
HILLS, ARIZONA, AMENDING THE OFFICIAL ZONING ORDINANCE OF THE TOWN OF
FOUNTAIN HILLS AS AUTHORIZED IN ARTICLE XXXI SECTION 31.1 OF THE
ZONING ORDINANCE FOR THE TOWN OF FOUNTAIN HILLS, AMENDING ARTICLE
XVIII, SECTION 18.2. PERTAINING TO PERMITTED USES IN THE C-1;
NEIGHBORHOOD COMMERCIAL ZONING DISTRICT
BE IT ORDAINED BY THE MAYOR AND COMMON COUNCIL OF THE TOWN OF FOUNTAIN
HILLS, ARIZONA AS FOLLOWS:
SECTION 1. Article XY_XI Section 31.1 of the Zoning Ordinance for the Town
of Fountain Hills authorizes Amendments to the Zoning Ordinance.
SECTION 2. Article XVIII, Section 18.2 of the Fountain Hills Zoning Code
is amended to read as follows:
Section 18.2 Use Regulations. A building or premise shall be used
for the following purposes:
(37) Restaurants and cafes, including drive through service,
but not including those having dancing or shows, or
drive-in car service. By special use permit only,
outside eating facilities may be allowed. The sale of
alcoholic beverages for on -site consumption may be
permitted as an accessory use subject to the following
requirements:
(a) The kitchen facilities in the restaurant shall be
no less than twenty (20%) percent of the floor
area.
(b) The floor plan of the restaurant including
outdoor seating area shall be approved by the
Department of Planning and Development.

Hills, Arizona, this 15th day of August, 1991.
